  7. Changes on the CardMember's Terms and Conditions 13 May 2013

    Kindly be informed that MBF Cards has made changes to the CardMember's Terms and Conditions for below mentioned clauses.

    Please note that these changes will take effect twenty one (21) days from the above notice date. Below are the revised clauses on the CardMember's Terms and Conditions:

    CardMember's Terms and Conditions (MBF Cards Line of Credit)

    TERMS AND CONDITIONS GOVERNING THE USE OF THE CARD
    Clause 2.13 and 2.18, Page 3

    2. Card
    2.1 The Card is and shall at all times remain our property and shall be surrendered to use immediately upon our request.
    2.2 We shall be entitled to at our absolute discretion to withhold or renew any Card.
    2.3 All charges, interest and debits set forth in the Statement of Account incurred by and/or in connection with the use of the Card must be paid to us.
    2.4 You shall not use the Card for any unlawful activities, including but not limited to illegal online betting and online gambling.
    2.5 If we do find that your Card has been used for unlawful activity, we shall be entitled to terminate the use of your Card without prior notice.
    2.6 For the purpose of effecting any cash advances via the Automated Teller Machines (ATM), we will provide a PIN to you. We will issue and deliver the PIN to you at your own risk. We may, without in any way being obligated to do so, request you to collect the PIN personally.
    2.7 The PIN is strictly confidential and you shall not disclose the PIN to any person under any circumstances or by any means whatsoever. You are to be fully responsible and liable for all transactions effected by the use of the PIN whether with or without your knowledge.
    2.8 You shall forthwith notify us in writing of any changes in your or your Supplementary CardMember(s) residential address, telephone number or change of employment or business.
    2.9 You are to update your particulars at our request from time to time.
    2.10 You must undertake all reasonable care and precaution to prevent loss or theft of the Card.
    2.11 You are obligated to inform us, or if outside Malaysia, to inform any member institution, Visa International and/or MasterCard International (which ever is applicable) immediately to confirm in writing if the Card is lost or stolen. You must immediately lodge a police report and forward a copy of the report to us.
    2.12 If the Card reported lost/stolen is subsequently recovered, you shall return the Card cut in half and punch a hole on the chip to us immediately upon recovery.
    2.13 For any unauthorized transactions made with your lost or stolen Card, you may be liable to repay the amount transacted:
    (a) up to RM250 if you have not acted fraudulently or have not failed to inform us as soon as reasonably practicable upon discovery of the loss or theft of your Card.
    (b) up to the full or maximum amount transacted if it is found and proven that you have acted fraudulently or failed to inform us as soon as reasonably practicable upon discovery of the loss or theft of your Card.
    2.14 You are liable for any unauthorised transactions if you have acted fraudulently and have failed to inform the issuer as soon as reasonably practicable upon discovery of the loss or theft of your credit card.
    2.15 All Cards are our property and may be with drawn at any time at our discretion without prior notice and without assigning any reason thereof. You hereby expressly consent to us withdrawing the Card at such places and at such times as we deem fit, including being in the presence of or to the knowledge of other persons whether or not the Statement of Account is in credit or otherwise. Subsequently, you shall return to us all Cards cutting half and punch a hole on the chip issued to you, when asked to do so, even if the use of the Card was suspended or cancelled by you.
    2.16 Upon cancellation or withdrawal of the Card, the entire unpaid balance under the Statement of Account shall be immediately due and payable to us.
    2.17 You may terminate this agreement by returning the Card cut in half and punch a hole on the chip to us. Until the Card is cut in half and punch a hole on the chip is received by us, your liabilities shall continue. Such termination shall be without prejudice to your obligation to pay to us all monies owing to us prior to the date of termination of this agreement.
    2.18 For sole purpose of fraud and crime prevention and under such circumstances, we shall be entitled to decline any transactions charged using the Card at any time without prior notice and/or the need to assign any reason. We shall also not be liable for any loss (including loss of reputation) or damages whatsoever and howsoever caused by our exercise of our right for such purpose and under such circumstances except as permitted in this Terms and Conditions and as permitted by law.
    2.19 We may, at your request, but without being obligated to do so, reinstate the Card cancelled by us due to credit reason(s).

    5. Excess of Credit Limit
    5.1 Excess Limit Service is a service extended by us to facilitate any transactions made in excess of your Credit Limit if you choose to spend beyond your assigned Credit Limit. If you choose to spend within your assigned Credit Limit, any transaction in excess of your Credit Limit will be declined.
    5.2 You are to notify us should you choose to spend beyond your assigned Credit Limit. Under this service, an Excess Limit fee of two percent (2%) of the amount above the assigned Credit Limit or a minimum of RM50 (whichever higher) shall be imposed if your transaction exceeds the Credit Limit.
    5.3 You shall ensure that the total amount owing to us in the Card Account does not exceed the Credit Limit. In this respect you shall solely be responsible for monitoring the utilization of the Card and we are under no duty or obligation to ensure that your Credit Limit is not exceeded.
    5.4 You undertakes to immediately settle all amounts in excess of the Credit Limit upon receipt of the Card Statement or upon demand, failing which we shall, without prejudice to its other rights herein contained, be entitled to immediately suspend, cancel or recall the Card without prior notice and liability to you.
    5.5 However, this would not be applicable to stand-in processing transactions, interest or any fees imposed by us and auto-debit transactions. Stand-in Processing transactions are transactions involving payment network authorization (Visa/MasterCard) service which is required for use if or when our authorization processor is unavailable. For auto-debit transactions, the Excess Limit Fee would still be imposed.

    18. Consent to Disclosure of Information
    18.1 By agreeing at the point of Card application, you hereby expressly give us your consent to authorize us at our absolute discretion deem fit and necessary to do the following things hereinafter set forth:
    a) to provide, exchange, obtain information relating to your Account or credit, to or from third parties including purposes of collection of monies from you via collection agents.
    b) to release any information relating to your Account to authorized third party for operational purposes such as fulfillment and statement printing.
    c) to give, produce, divulge, reveal, publish or otherwise disclose, or make a record of your personal particulars submitted to us in respect to any credit bureau or agencies approved by the Association of Finance Companies of Malaysia, the Central Credit Union of Bank Negara Malaysia and other body of authority (governmental or otherwise) as we may deem fit under any applicable law, regulation, guidelines, regulatory requirement or directive (whether having force of law or otherwise), and such information or document whatsoever relating to your affair or account (including but not limited to your credit standing) in respect to third parties making enquiries with the view to entering into prospective transactions with you.
    d) to lodge reports (including police reports) and/or circulars and/or insert advertisements (including status) and particulars of the subject matter of the credit line arising from any difficulty that we may experience for any reasons whatsoever in enforcing the rights under the Terms and Conditions contained herein.
    e) to check your personal particulars, dealings and credit standing with whatsoever financial institutions by obtaining therefrom such information as maybe required by us, whether by way of oral communication or through documents.
    f) to give, release, produce, divulge, reveal, publish or otherwise disclose information relating to your particulars, dealings, credit standing which maybe in our possession in connection with your account or any other credit facilities which you may have obtained from which may be at the material time, conducting a credit check on you or the guarantors of any loans and/or credit facilities.
    g) to obtain, exchange and/or release information with any establishment to whom the Card may be accepted and any member institution of the Card.
    h) we may at any time, obtain, exchange and/or release the CardMember's particulars to any third party, including ours Business Partners, and/or any group of Company for marketing, promotional and/or other purposes, as we deems appropriate at its absolute discretion. You will be given the option to disallow such disclosure for marketing and promotional purposes, by informing us in writing.
    i) we may at any time, release and/or disclose your information (not including the Card Number, Identification Number and/or Financial Status) to our associate and selected parties appointed by us, for any purpose deemed appropriate and/or necessary by us for the purposes to facilitate the performance, functions, operations and services process.


    CardMember's Terms and Conditions (AmBank Line of Credit)

    Lost and/or Stolen Card

    2. a) The CardMember agrees and undertakes to take all reasonable care and precaution to prevent loss or theft of the Card.
      b) The CardMember shall inform MBFC, or if outside Malaysia, to inform any member institution of MasterCard International and/or Visa International (whichever is applicable) immediately and to confirm in writing if the Card is lost or stolen. The CardMember must also immediately lodge a police report and forward a copy of the report to MBFC.
      c) For any unauthorized transactions made with the CardMember's lost or stolen Card, the CardMember may be liable to repay the amount transacted:
    (i) up to RM250 if the CardMember have not acted fraudulently or have not failed to inform MBFC as soon as reasonably practicable upon discovery of the loss or theft of their Card.
    (ii) up to the full or maximum amount transacted if it is found and proven that the CardMember have acted fraudulently or failed to inform MBFC as soon as reasonably practicable upon discovery of the loss or theft of their Card.
      d) CardMember is liable for any unauthorised transactions if the CardMember has acted fraudulently and has failed to inform the issuer as soon as reasonably practicable upon discovery of the loss or theft of the CardMember's Credit Card.
      e) If the Card reported lost/stolen is subsequently recovered, the CardMember shall return the Card cut in half and punch a hole on the chip to MBFC immediately upon recovery.

    Withdrawal/Denial of Use of the Card

    4. a) All Cards issued are the property of MBFC and may be withdrawn at any time at the discretion of MBFC without prior notice and without assigning any reason thereof. The CardMember hereby expressly consents to MBFC withdrawing the Card at such places and at such times as MBFC deems fit including being in the presence of or to the knowledge of other persons whether or not the Statement of Charge Account is in credit or otherwise. The CardMember shall return to MBFC all Cards cut in half and punch a hole on the chip issued to the CardMember, when asked to do so or if the use of the Card by the CardMember is suspended or cancelled.
      b) Upon withdrawal of the use of the Card, the entire unpaid balance under the Statement of Charge Account shall be immediately due and payable.
      c) The CardMember may terminate this Agreement by returning the Card cut in half and punch a hole on the chip to MBFC and until the Card is cut in half and punch a hole on the chip is received, the liabilities of the CardMember and the Supplementary CardMembers shall continue. Such termination shall be without prejudice to the liabilities of the CardMember and the Supplementary CardMembers for all monies owing to MBFC prior to the date of termination.
      d) For sole purpose of fraud and crime prevention and under such circumstances, MBFC shall be entitled to decline any transactions charged using the Card at any time without prior notice and/or the need to assign any reason. MBFC shall also not be liable for any loss (including loss of reputation) or damages whatsoever and howsoever caused by MBFC's exercise of its right for such purpose and under such circumstances except as permitted in this Terms and Conditions and as permitted by law.

    TERMS AND CONDITIONS ON LINE OF CREDIT OFFERED BY LINE OF CREDIT PROVIDER

    17. Excess of Credit Limit
    a) Excess Limit Service is a service extended by MBFC to facilitate any transactions made in excess of the CardMember's Credit Limit if they choose to spend beyond their assigned Credit Limit. If the CardMember choose to spend within their assigned Credit Limit, any transaction in excess of their Credit Limit will be declined.
    b) The CardMember are to notify MBFC should they choose to spend beyond their assigned Credit Limit. Under this service, an Excess Limit fee of two percent (2%) of the amount above the assigned Credit Limit or a minimum of RM50 (whichever higher) shall be imposed if the CardMember transaction exceeds the Credit Limit.
    c) The CardMember shall ensure that the total amount owing to MBFC in the Card Account does not exceed the Credit Limit. In this respect the CardMember shall solely be responsible for monitoring the utilization of the Card and MBFC is under no duty or obligation to ensure that the CardMember's Credit Limit is not exceeded.
    d) The CardMember undertakes to immediately settle all amounts in excess of the Credit Limit upon receipt of the Card Statement or upon demand, failing which MBFC shall, without prejudice to its other rights herein contained, be entitled to immediately suspend, cancel or recall the Card without prior notice and liability to the CardMember.
    e) However, this would not be applicable to stand-in processing transactions, interest or any fees imposed by MBFC and auto-debit transactions. Stand-in Processing transactions are transactions involving payment network authorization (Visa/MasterCard) service which is required for use if or when MBFC authorization processor is unavailable. For auto-debit transactions, the Excess Limit Fee would still be imposed.

    29. Information
      By agreeing at the point of Card application, the CardMember hereby expressly gives his consent to and authorizes the Line of Credit Provider as and when the Line of Credit Provider may at its absolute discretion deem fit and necessary to do the following things hereinafter set forth:
    a) to provide, exchange or obtain information relating to his account or credit, to or from third parties including for the purposes of collection of monies from the CardMember via collection agent(s);
    b) to release any information relating to the CardMember's Account to authorized third party for operational purposes such as fulfillment and statement printing.
    c) to give, produce, divulge, reveal, publish or otherwise disclose, or make a record of, the CardMember's personal particulars submitted to MBFC and/or the Line of Credit Provider in connection with the Line of Credit and such other information or document whatsoever in respect of the Line of Credit to any credit bureau or agencies approved by the Association of Finance Companies of Malaysia, the Central Credit Unit of Bank Negara Malaysia and other body of authority (governmental or otherwise) as the Line of Credit Provider may deem fit under any applicable law, regulation, guidelines, regulatory requirement or directive (whether having the force of law or otherwise), and such information or document whatsoever relating to the CardMember's affair or account (including but not limited to his credit standing) in respect of the Line of Credit to third parties making enquiries with the view to entering into prospective transactions with him;
    d) to lodge reports (including Police reports) and/or circulars and/or insert advertisements (including any advertisement in any media) incorporating the CardMember's personal particulars (including but not limited to his financial status) and particulars of the subject matter of the Line of Credit arising from any difficulty that the Line of Credit Provider may experience for any reasons whatsoever in enforcing its rights under the Terms and Conditions contained herein;
    e) to check the CardMember's personal particulars, dealings and credit standing with whatsoever financial institutions by obtaining therefrom such information as may be required by the Line of Credit Provider, whether by way of oral communication or through documents; and
    f) to give, release, produce, divulge, reveal, publish or otherwise disclose information relating to the CardMember's particulars, dealings and credit standing which may be in the Line of Credit Provider's possession in connection with the Line of Credit or any other credit facilities which the CardMember may have obtained from the Line of Credit Provider to any other financial institutions which may at the material time be conducting a credit check on him or to the guarantors of any other loans and/or credit facilities whatsoever which the CardMember may obtain from the Line of Credit Provider of any other financial institution.

    40. CardMember's Liability
    a) The Principal CardMember is liable not only for all charges, fees, interest, late payment charges and other costs and incidental expenses incurred by him and debited to the Line of Credit Account but also agrees to be jointly and severally liable with his Supplementary CardMember(s) for all charges, fees, interest, late payment charges and other costs and incidental expenses incurred by his Supplementary CardMember(s) and debited to the Line of Credit Account.
    b) In consideration of the Line of Credit Provider making or continuing to make advances or otherwise giving credit or affording the Line of Credit for as long as the Line of Credit Provider may think fit to the CardMember and in further consideration of the Line of Credit Provider agreeing to disburse (subject to the Terms and Conditions of the Line of Credit in force from time to time) advances to settle charges, fees, late payment charges or other costs and incidental expenses and, where applicable, cash advances incurred by the Supplementary CardMember(s) in the use of his Supplementary Card(s), the Supplementary CardMember(s) agrees to be jointly and severally liable with the Principal CardMember for all said charges, fees, interest, late payment charges, legal and other costs and incidental expenses incurred by the Supplementary CardMember(s) and debited to the Line of Credit Account.
    c) The Supplementary CardMember hereby agrees and consents that the Line of Credit Provider may at all times without prejudice to and without discharging or in any way affecting the liability of the Supplementary CardMember hereunder:
    i) determine, vary, decrease or increase the Line of Credit Limit to the Principal CardMember and/or Supplementary CardMember(s);
    ii) vary or modify the Terms and Conditions of the use of the Line of Credit to the Supplementary CardMember(s);
    iii) grant to the Principal CardMember or any other Supplementary CardMember(s) or any other person(s) any time or indulgence;
    iv) deal with, exchange, release, modify or abstain from perfecting or enforcing any security or other guarantee or rights which the Line of Credit Provider may now or hereafter have from or against the CardMember or any other person;
    v) compound or compromise with the CardMember or guarantor or any other person.
    d) The Statement of Line of Credit Account of the Line of Credit Provider as to the monies and liability for the time being due or incurred by the Supplementary CardMember(s) to the Line of Credit Provider shall be conclusive evidence in any legal proceedings against the Supplementary CardMember(s).
    e) For any unauthorized transactions made with the CardMember's lost or stolen Card, the CardMember may be liable to repay the amount transacted:
    (i) up to RM250 if the CardMember have not acted fraudulently or have not failed to inform MBFC as soon as reasonably practicable upon discovery of the loss or theft of their Card.
    (ii) up to the full or maximum amount transacted if it is found and proven that the CardMember have acted fraudulently or failed to inform MBFC as soon as reasonably practicable upon discovery of the loss or theft of their Card.

We may at our absolute discretion resolve that your liability be limited to RM250.00 provided you have not acted fraudulently or have failed to inform us as soon as reasonably practicable after having found that your Card is lost or stolen.
    2.14 You are liable for any unauthorised transactions if you have acted fraudulently and have failed to inform the issuer as soon as reasonably practicable upon discovery of the loss or theft of your credit card.
    2.15 All Cards are our property and may be with drawn at any time at our discretion without prior notice and without assigning any reason thereof. You hereby expressly consent to us withdrawing the Card at such places and at such times as we deem fit, including being in the presence of or to the knowledge of other persons whether or not the Statement of Account is in credit or otherwise.     2.17 You may terminate this agreement by returning the Card cut in half and punch a hole on the chip to us. Until the Card is cut in half and punch a hole on the chip is received by us, your liabilities shall continue. Such termination shall be without prejudice to your obligation to pay to us all monies owing to us prior to the date of termination of this agreement.
    2.18 We may without prior notice at our sole discretion without any liability whatsoever deny any transaction charge using the Card(s) at any time and we are under no obligation to offer any explanation whatsoever for such denial.
    2.19 We may, at your request, but without being obligated to do so, reinstate the Card cancelled by us due to credit reason(s).

    18.

    Consent to Disclosure of Information

    18.1 By agreeing at the point of Card application, you hereby expressly give us your consent to authorise us at our absolute discretion deem fit and necessary to do the following things hereinafter set forth:
    a) to provide, exchange, obtain information relating to your Account or credit, to or from third parties including purposes of collection of monies from you via collection agents.
    b) to release any information with respect of the Account and your financial affairs at all times to third party without any further reference to you.
    c) to give, produce, divulge, reveal, publish or otherwise disclose, or make a record of your personal particulars submitted to us in respect to any credit bureau or agencies approved by the Association of Finance Companies of Malaysia, the Central Credit Union of Bank Negara Malaysia and other body of authority (governmental or otherwise) as we may deem fit under any applicable law, regulation, guidelines, regulatory requirement or directive (whether having force of law or otherwise), and such information or document whatsoever relating to your affair or account (including but not limited to your credit standing) in respect to third parties making enquiries with the view to entering into prospective transactions with you.
    d) to lodge reports (including police reports) and/or circulars and/or insert advertisements (including status) and particulars of the subject matter of the credit line arising from any difficulty that we may experience for any reasons whatsoever in enforcing the rights under the Terms and Conditions contained herein.
    e) to check your personal particulars, dealings and credit standing with whatsoever financial institutions by obtaining therefrom such information as maybe required by us, whether by way of oral communication or through documents.
    f) to give, release, produce, divulge, reveal, publish or otherwise disclose information relating to your particulars, dealings, credit standing which maybe in our possession in connection with your account or any other credit facilities which you may have obtained from which may be at the material time, conducting a credit check on you or the guarantors of any loans and/or credit facilities.
    g) to obtain, exchange and/or release information with any establishment to whom the Card may be accepted and any member institution of the Card.
    h) we may at any time, obtain, exchange and/or release the CardMember's particulars to any third party, including ours Business Partners, and/or any group of Company for marketing, promotional and/or other purposes, as we deems appropriate at its absolute discretion. You will be given the option to disallow such disclosure for marketing and promotional purposes, by informing us in writing.
    i) we may at any time, release and/or disclose your information (not including the Card Number, Identification Number and/or Financial Status) to our associate and selected parties appointed by us, for any purpose deemed appropriate and/or necessary by us for the purposes to facilitate the performance, functions, operations and services process.

    Lost and/or Stolen Card

    2. a) The CardMember agrees and undertakes to take all reasonable care and precaution to prevent loss or theft of the Card.
      b) The CardMember shall inform MBFC, or if outside Malaysia, to inform any member institution of MasterCard International and/or Visa International (whichever is applicable) immediately and to confirm in writing if the Card is lost or stolen. The CardMember must also immediately lodge a police report and forward a copy of the report to MBFC.
      c) The CardMember shall be liable for all transactions incurred from any unauthorised usage of the Card until a report of the loss or theft has been received by MBFC. MBFC may at its absolute discretion resolve that the CardMember's liability be limited to RM250.00 provided the CardMember has not acted fraudulently or has failed to inform MBFC as soon as reasonably practicable after having found that his/her Card is lost or stolen.
      d) CardMember is liable for any unauthorised transactions if the CardMember has acted fraudulently and has failed to inform the issuer as soon as reasonably practicable upon discovery of the loss or theft of the CardMember's Credit Card.
      e) If the Card reported lost/stolen is subsequently recovered, the CardMember shall return the Card cut in half and punch a hole on the chip to MBFC immediately upon recovery.

    Consent to Disclosure of Information

    22. By agreeing at the point of Card application, the CardMember hereby expressly gives his consent and authorises to;

    a) MBFC may at all times obtain, exchange and/or release information with:
    i) any Establishment to whom the Card may be accepted, Line of Credit Provider and any member institution of the Card;
    ii) associate and related Companies of MBFC, its agents, servants and/or associates, any credit bureaus (local or foreign) or such persons, companies or groups, colleagues, employers, employees, superiors, and business partners of the CardMember, as MBFC deems necessary at its absolute discretion or as required by law; and any information with respect to the Statement of Charge Account, the use of Card and the financial affairs of the CardMember and similarly they may at all time disclose such information to MBFC.
    b) The CardMember agrees that MBFC may at any time, obtain, exchange and/or release the CardMember's particulars to any third party, including MBFC's Business Partners, and/or any group of Company for marketing, promotional and/or other purposes, as MBFC deems appropriate at its absolute discretion. CardMember will be given the option to disallow such disclosure for marketing and promotional purposes, by informing MBFC in writing.
    c) MBFC is authorised to lodge reports (including Police reports) and/or circulars (including posting notices on the Internet) and/or insert advertisements (including any advertisements in any media) incorporating the CardMember's personal particulars (including but not limited to his financial status) and particulars of the subject matter of the CardMember's Charge Account arising from any difficulty that MBFC may experience in recovering monies outstanding under the CardMember's Charge Account.
    d) MBFC may at any time, release and/or disclose CardMember's information (not including the Card Number, Identification Number and/or Financial Status) to MBFC's associate and selected parties appointed by MBFC, for any purpose deemed appropriate and/or necessary by MBFC for the purposes to facilitate the performance, functions, operations and services process.

    40. CardMember's Liability

    a) The Principal CardMember is liable not only for all charges, fees, interest, late payment charges and other costs and incidental expenses incurred by him and debited to the Line of Credit Account but also agrees to be jointly and severally liable with his Supplementary CardMember(s) for all charges, fees, interest, late payment charges and other costs and incidental expenses incurred by his Supplementary CardMember(s) and debited to the Line of Credit Account.
    b) In consideration of the Line of Credit Provider making or continuing to make advances or otherwise giving credit or affording the Line of Credit for as long as the Line of Credit Provider may think fit to the CardMember and in further consideration of the Line of Credit Provider agreeing to disburse (subject to the Terms and Conditions of the Line of Credit in force from time to time) advances to settle charges, fees, late payment charges or other costs and incidental expenses and, where applicable, cash advances incurred by the Supplementary CardMember(s) in the use of his Supplementary Card(s), the Supplementary CardMember(s) agrees to be jointly and severally liable with the Principal CardMember for all said charges, fees, interest, late payment charges, legal and other costs and incidental expenses incurred by the Supplementary CardMember(s) and debited to the Line of Credit Account.
    c) The Supplementary CardMember hereby agrees and consents that the Line of Credit Provider may at all times without prejudice to and without discharging or in any way affecting the liability of the Supplementary CardMember hereunder:
    i) determine, vary, decrease or increase the Line of Credit Limit to the Principal CardMember and/or Supplementary CardMember(s);
    ii) vary or modify the Terms and Conditions of the use of the Line of Credit to the Supplementary CardMember(s);
    iii) grant to the Principal CardMember or any other Supplementary CardMember(s) or any other person(s) any time or indulgence;
    iv) deal with, exchange, release, modify or abstain from perfecting or enforcing any security or other guarantee or rights which the Line of Credit Provider may now or hereafter have from or against the CardMember or any other person;
    v) compound or compromise with the CardMember or guarantor or any other person.
    d) The Statement of Line of Credit Account of the Line of Credit Provider as to the monies and liability for the time being due or incurred by the Supplementary CardMember(s) to the Line of Credit Provider shall be conclusive evidence in any legal proceedings against the Supplementary CardMember(s).
    e) The CardMember shall be liable for all transactions incurred from any unauthorised usage of the Card until a report of the loss or theft has been received by MBFC. Line of Credit Provider may at its absolute discretion resolve that the CardMember's liability be limited to RM250.00 provided the CardMember has not acted fraudulently or has failed to inform MBFC as soon as reasonably practicable after having found that his/her Card is lost or stolen.

    MBFC (ours, us and we) : MBF Cards (M'sia) Sdn. Bhd., a company incorporated in Malaysia and having its registered office at 22nd Floor, Bangunan AmBank Group, No. 55 Jalan Raja Chulan, 50200 Kuala Lumpur and includes persons deriving title thereunder and its successors in titles and assigns.
     
    Line of Credit Limit : The prescribed spending limit set by MBFC to the CardMember(s) and which amount shall be set by MBFC from time to time and notified by MBFC to the CardMember(s) in writing upon receiving the consent from the CardMember.
     
    Interest Free Period : The Interest Free Period refers to the period where no interest will be charged on retail transactions for twenty (20) days between the statement date and the payment due date, provided that your previous month's outstanding balance have been settled in full. If you opt to pay a partial or the minimum repayment amount from the previous statement, interest on your retail transaction will be calculated from the day the transaction is posted to your card account. A grace period of four (4) days from the payment due date is given to settle payments on your card account.

    1. Using Your Card and Line of Credit Limit
     
    1.1 You shall immediately place your signature at the back of the Card upon your receipt of the Card. Whether you sign at the Card or not, you are fully responsible for complying with these Terms and Conditions or other Terms and Conditions as we may prescribe from time to time, including the obligation to pay us for all balances due as per your Statement of Account.
     
    1.2 The use of your Card shall also be subject to prevailing terms, conditions and regulations of Bank Negara Malaysia and Foreign Exchange Administration Rules.
     
    1.3 The Card is not transferable and no other person except you shall be entitled to sign bills or transact with the designated merchants and financial institutions authorised to display Visa and/or MasterCard signage.
     
    1.4 At our discretion, we may revise the Line of Credit Limit at any time as we see fit. Any change in the Line of Credit Limit shall be communicated to you within the notice period, prior to the effective date of change.
     
    1.5 The total amount charged to your Account, including purchases, cash advances, finance charges, fees and other charges should be within the Line of Credit Limit. However, if that total amount exceeds the Line of Credit Limit, you must still pay to us all outstanding amount owing to us.
     
    1.6 We may at our absolute discretion approve any transactions which may or may not cause you to exceed the Line of Credit Limit without waiving our rights under this agreement.
     
    1.7 The MBF EPP Line of Credit Limit (subject to approval) is provided by MBF Cards for the purpose of purchase(s) made via MBF Cards XtremeDeals Program. If you fail to pay the full monthly MBF EPP installment, interest shall be imposed on the current balance amount under the MBF EPP program.

    4. Statement of Account
     
    4.1 A physical Statement of Account will be sent to your last known address in our records and such statement shall be deemed to have been received by you on the fifth (5) day after mailing. In the event you have opted to receive your Statement of Account via our electronic statement (e-Statement) facility, your Statement of Account will be sent to your valid email address registered with us within four (4) days from the statement generated date. Upon receipt of your statement, you are deemed to have examined all entries in the statement.
     
    4.2 You must report in writing to us of any error in the statement within fourteen (14) days from the date you received or are deemed to have received the statement. If for any reason whatsoever, we do not receive a written notification from you within the aforesaid fourteen (14) days of any error in the statement, then you shall be deemed to have accepted the entries in the statement made up to the date of the last entry in the statement as correct and as final and conclusive evidence of the facts contained in the statement. A Certificate of Indebtedness issued by our officer as to the amount for the time being due and owing to us by you shall be final and conclusive evidence in the Court of Law of the total outstanding amount owing and due to us in the Statement of Account.
     
    4.3 The Statement of Account will be considered conclusive and binding as against you and your legal representatives and successors and you shall therefore be precluded from making any claim against us by alleging that the statement contains any error. For the avoidance of doubt, proof of sending of a written notification to us is not proof of receipt by us of your written notification if we are not in receipt of your written notification.
     
    4.4 It is hereby expressly agreed that the Statement of Account issued by us shall be accepted by the parties hereto as final and conclusive evidence in a Court of Law of all monies due and owing including all late payment interest, costs, charges, incidental expenses and interest accrued and/or cash advances incurred by you.
     
    4.5 Any refunds made by Merchants will be credited and stated in the Statement of Account after we have received a properly issued credit slip.

    5. Excess of Credit Limit
     
    5.1 Any transactions in excess of the assigned Credit Limit will be subject to the CardMember's good conduct of account and the excess limit allowable is only at the discretion of MBFC.
     
    5.2 An Excess Limit Fee of two percent (2%) of the amount above the assigned Credit Limit or a minimum of RM50, whichever higher, shall be imposed on CardMembers if their transaction exceeds the Credit Limit.
     
    5.3 The CardMember shall ensure that the total amount owing to MBFC in the Card Account does not exceed the Credit Limit. In this respect the CardMember shall solely be responsible for monitoring the utilization of the Card and MBFC is under no duty or obligation to ensure that the CardMember's Credit Limit is not exceeded.
     
    5.4 The CardMember undertakes to immediately settle all amounts in excess of the Credit Limit upon receipt of the Card Statement or upon demand, failing which MBFC shall, without prejudice to its other rights herein contained, be entitled to immediately suspend, cancel or recall the Card with prior notice and liability to the CardMember.
     
    5.5 CardMember must notify MBFC should they choose to spend within their assigned Credit Limit. Once CardMember have done so, any transactions in excess of the assigned Credit Limit will be declined. However, this would not be applicable to stand-in processing transactions, interest or any fees imposed by MBFC and auto-debit transactions. Stand-in Processing transactions are transactions involving payment network authorization (Visa/MasterCard) service which is required for use if or when MBFC authorization processor is unavailable. For auto-debit transactions, the Excess Limit Fee would still be imposed.

    6. Payment for Credit Cards
     
    6.1 Payment made to us shall be the highest of the following:
    a) Five percent (5%) of the total amount owing based on the Statement of Account plus the Minimum of Repayment amount(s) due and unpaid as shown in the preceding statement, if any; or
     
    b) Where the total amount owing by you has exceeded the Line of Credit limit, such amount in excess of the Line of Credit Limit plus five percent (5%) of the Line of Credit Limit plus the Minimum Repayment amount(s) due and unpaid as shown in the preceding Statement of Accounts; or
     
    c) Such other amount as may be stipulated in the Statement of Account by us; PROVIDED ALWAYS that the Minimum Repayment shall not be less than RM50.00.

    7 Credit Card Interest
    7.1 The Prescribed Rate will be the interest rate reflected in the Statement of Account. We shall be entitled at our absolute discretion by giving notice to you as the Principal CardMember, vary the Prescribed Rate at any time. Interest at the Prescribed Rate is also payable on the judgement sum after the date of any judgement obtained against you.
     
    7.2 Notwithstanding any other provision herein, you shall, where applicable, pay to us the interest at the Prescribed Rate for all cash advances from the date of cash advance until full payment is received by us and credited into your Card Account.
     
    7.3 Interest at the Prescribed Rate shall be computed as follows :
     
    a) There is no interest-free period for Cash Advances. Interest is calculated on any outstanding Cash Advance balance commencing from the date of disbursement until full settlement.
     
    b) Interest is imposed on any outstanding Retail and Other Transactions that are not paid by the due date immediately following the statement date in which the transactions were posted, commencing from the due date until full settlement.
     
    c) No interest is imposed if balance of Retail and Other Transactions from the previous month's statement are settled in full by the due date.
     
    d) The tiered interest rates apply to Cash Advance and generic Balance Transfer program unless stated otherwise.
     
    e) Tiered Interest Rate Categories shall be :

    7.4 Interest at the Prescribed Rate shall be charged on the transaction referred to in Clauses 7.2 and 7.3 above, and shall continue to be charged and payable by you until full payment is received by us and credited into your Statement of Account.
     
    7.5 Interest on any Retail and Other Transactions and/or cash advance transactions, late payment interest and all costs, charges and incidental expenses shall on the Statement of Account date be capitalised and added for all purposes to the total outstanding amount then owing and shall thereafter bear interest at the Prescribed Rate.
     
    7.6 The obligation to pay interest at the Prescribed Rate and late payment interest are independent obligations and accordingly shall be applicable whether before or after judgement, and shall not merge with the judgement.
     
    7.7 If you default in the payment of the Minimum Repayment, you shall in addition and without prejudice to our rights and the remedies which we may have under this Agreement, pay to us the late payment interest rate of one percent (1%) of the total balance outstanding as at your statement date or a minimum of RM10, whichever is higher (up to a maximum of RM100).
     
    7.8 Upon termination of your Card, you shall in addition and without prejudice to the power, rights and remedies of us, including but not limited to the right to recover the total amount owing to us, interest at the Prescribed Rate and late payment interest pursuant to Clause 7.7 above, pay us late payment interest at the rate of one percent (1%) per month or such other rate as we may prescribe from time to time within the notice period on the total amount owing by you under your Account.

    Miscellaneous

    30. Using Your Card and Line of Credit Limit
     
    1.1 A physical Statement, notices, legal process shall be deemed to have been received five (5) days after posting to the CardMember or Supplementary CardMember at the last known address notified to MBFC. In the event CardMember have opted to receive the Statement via MBFC electronic statement (e-Statement) facility, CardMember's Statement will be sent to their valid email address registered with MBFC within four (4) days from the statement generated date.

    8. Interest

    d) to lodge reports (including police reports) and/or circulars and/or insert advertisements (including status) and particulars of the subject matter of the credit line arising from any difficulty that we may experience for any reasons whatsoever in enforcing the rights under the Terms and Conditions contained herein.
    e) to check your personal particulars, dealings and credit standing with whatsoever financial institutions by obtaining therefrom such information as may be required by us, whether by way of oral communication or through documents.
    f) to give, release, produce, divulge, reveal, publish or otherwise disclose information relating to your particulars, dealings, credit standing which may be in our possession in connection with your account or any other credit facilities which you may have obtained from which may be at the material time, conducting a credit check on you or the guarantors of any loans and/or credit facilities.

    d) to lodge reports (including Police reports) and/or circulars and/or insert advertisements (including any advertisement in any media) incorporating the CardMember's personal particulars (including but not limited to his financial status) and particulars of the subject matter of the Line of Credit arising from any difficulty that the Line of Credit Provider may experience for any reasons whatsoever in enforcing its rights under the Terms and Conditions contained herein;
    e) to check the CardMember's personal particulars, dealings and credit standing with whatsoever financial institutions by obtaining therefrom such information as may be required by the Line of Credit Provider, whether by way of oral communication or through documents; and
    f) to give, release, produce, divulge, reveal, publish or otherwise disclose information relating to the CardMember's particulars, dealings and credit standing which may be in the Line of Credit Provider's possession in connection with the Line of Credit or any other credit facilities which the CardMember may have obtained from the Line of Credit Provider to any other financial institutions which may at the material time be conducting a credit check on him or to the guarantors of any other loans and/or credit facilities whatsoever which the CardMember may obtain from the Line of Credit Provider of any other financial institution.

    c) MBFC shall not be held responsible, in the event CardMember (be it Principal or Supplementary) does not receive the "OTP" due to mobile phone number not valid or not available and/or system failure (including but not limited to MBFC's and 3rd party system, any electronic, mechanical, system failure or corruption, computer viruses, bugs or related problems, operating system malfunction, telecommunication network or internet or network failure, power breakdown or UPS breakdown or any other reason beyond the reasonable control that may be attributable to services provided by any relevant internet service provider, network provider or communication network provider or any other provider) which will result in CardMember not being able to make purchase online at participating 3D Secure merchants.
    d) In event where CardMember require any services of and/or software support provided by third parties, who are not under MBFC control, to access and operate Services, MBFC do not warrant the security and confidentiality of information transmitted through the internet service provider, network provider or communication network provider or any equivalent system in any jurisdiction.
    e) CardMember is solely responsible for CardMember's computer, system or any device from which CardMember uses to access the service, including without limitation the maintenance, operation and permitted use of such computer, system or other device and that it is CardMember's is obligation to comply with any criteria imposed by MBFC from time to time with respect to CardMember's computer, system or any device.
    f) The "OTP" issued to the CardMember is strictly confidential and the CardMember shall not disclose the "OTP" to any person under any circumstances or by any means whatsoever. CardMember is fully responsible for all online transactions effected by the use of the "OTP".
    g) CardMember will receive "OTP" via SMS when abroad if the CardMember's mobile phone number is on roaming mode at CardMember's own cost of the prevailing Telco charges.

    2. Card

    2.1 The Card is and shall at all times remain our property and shall be surrendered to us immediately upon our request.
    2.2 We shall be entitled to at our absolute discretion to withhold or renew any Card.
    2.3 All charges, interest and debits set forth in the Statement of Account incurred by and/or in connection with the use of the Card must be paid to us.
    2.4 The CardMember shall not use the Card for any unlawful activities, including but not limited to illegal online betting and online gambling.
    2.5 If we do find that your Card number has been used for unlawful activity, we shall be entitled to terminate the use of your Card without prior notice.
    2.6 For the purpose of effecting any cash advances via the Automated Teller Machines (ATM), we will provide a PIN to you. We will issue and deliver the PIN to you at your own risk. We may, without in any way being obligated to do so, request you to collect the PIN personally.
    2.7 The PIN is strictly confidential and you shall not disclose the PIN to any person under any circumstances or by any means whatsoever. You are to be fully responsible and liable for all transactions effected by the use of the PIN whether with or without your knowledge.
    2.8 You shall forthwith notify us in writing of any changes in your or your Supplementary CardMember(s) residential address, telephone number or change of employment or business.
    2.9 You are to update your particulars at our request from time to time.
    2.10 You must undertake all reasonable care and precaution to prevent loss or theft of the Card.
    2.11 You are obligated to inform us, or if outside Malaysia, to inform any member institution, Visa International and/or MasterCard International (whichever is applicable) immediately to confirm in writing if the Card is lost or stolen. You must immediately lodge a police report and forward a copy of the report to us.
    2.12 If the Card reported lost/stolen is subsequently recovered, you shall return the Card cut in half and punch a hole on the chip to us immediately upon recovery.
    2.13 Your maximum liability for unauthorised transactions as a consequence for lost or stolen Card(s) shall be confined to a limit specified by us, which shall not exceed RM250, PROVIDED ALWAYS that you have taken all reasonable care and precaution to prevent the loss and/or theft of the Card, have not acted fraudulently and have informed us as soon as reasonably practicable after having found that your Card is lost or stolen.
    2.14 CardMember is liable for any unauthorised transactions if the CardMember has not taken all reasonable care and precaution to prevent the loss and/or theft of the Card or has acted fraudulently and has failed to inform the issuer as soon as reasonably practicable upon discovery of the loss or theft of the CardMember's credit card.
    2.15 All Cards are our property and may be withdrawn at any time at our discretion without prior notice and without assigning any reason thereof. You hereby expressly consent to us withdrawing the Card at such places and at such times as we deem fit, including being in the presence of or to the knowledge of other persons whether or not the Statement of Account is in credit or otherwise. Subsequently, you shall return to us all Cards cut in half and punch a hole on the chip issued to you, when asked to do so, even if the use of the Card was suspended or cancelled by you.
    2.16 Upon cancellation or withdrawal of the Card, the entire unpaid balance under the Statement of Account shall be immediately due and payable to us.
    2.17 You may terminate this agreement by returning the Card cut in half and punch a hole on the chip to MBFC. Until the Card is cut in half and punch a hole on the chip is received by us, your liabilities shall continue. Such termination shall be without prejudice to your obligation to pay to us all monies owing to us prior to the date of termination of this agreement.
    2.18 We may without prior notice at our sole discretion without any liability whatsoever deny any transaction charge using the Card(s) at any time and we are under no obligation to offer any explanation whatsoever for such denial.
    2.19 We may, at your request, but without being obligated to do so, reinstate the Card cancelled by us due to credit reason(s).

    d) MBFC shall not be liable for any delays, failure to deliver, or misdirected delivery of the OTP SMS that may be affected by outages, faults or delays. These may be caused by technical difficulties, CardMember's or a third party's software, equipment or systems, traffic, infrastructure failures or actions taken by third parties.
    e) In event where CardMember require any services of and/or software support provided by third parties, who are not under MBFC control, to access and operate Services, MBFC do not warrant the security and confidentiality of information transmitted through the internet service provider, network provider or communication network provider or any equivalent system in any jurisdiction.
    f) CardMember is solely responsible for CardMember's computer, system or any device from which CardMember uses to access the service, including without limitation the maintenance, operation and permitted use of such computer, system or other device and that it is CardMember's is obligation to comply with any criteria imposed by MBFC from time to time with respect to CardMember's computer, system or any device.

    Lost and/or Stolen Card

    c) MBFC may resolve that the CardMember's liabilities shall be limited to RM250.00 for any debits to the CardMember's Account arising from all transactions effected before receipt of such notification to MBFC, PROVIDED ALWAYS that the CardMember has taken all reasonable care and precaution to prevent the loss and/or theft of the Card or has not acted fraudulently and has informed MBFC or its agent promptly upon discovering that the Card is lost or stolen.
    d) CardMember is liable for any unauthorised transactions if the CardMember has not taken all reasonable care and precaution to prevent the loss and/or theft of the Card or has acted fraudulently and has failed to inform the issuer as soon as reasonably practicable upon discovery of the loss or theft of the CardMember's Credit Card.
    e) If the Card reported lost/stolen is subsequently recovered, the CardMember shall return the Card cut in half and punch a hole on the chip to MBFC immediately upon recovery.


    TERMS AND CONDITIONS ON LINE OF CREDIT OFFERED BY LINE OF CREDIT PROVIDER

    39. CardMember's Liability

    a) The Principal CardMember is liable not only for all charges, fees, interest, late payment charges and other costs and incidental expenses incurred by him and debited to the Line of Credit Account but also agrees to be jointly and severally liable with his Supplementary CardMember(s) for all charges, fees, interest, late payment charges and other costs and incidental expenses incurred by his Supplementary CardMember(s) and debited to the Line of Credit Account.
    b) In consideration of the Line of Credit Provider making or continuing to make advances or otherwise giving credit or affording the Line of Credit for as long as the Line of Credit Provider may think fit to the CardMember and in further consideration of the Line of Credit Provider agreeing to disburse (subject to the Terms and Conditions of the Line of Credit in force from time to time) advances to settle charges, fees, late payment charges or other costs and incidental expenses and, where applicable, cash advances incurred by the Supplementary CardMember(s) in the use of his Supplementary Card(s), the Supplementary CardMember(s) agrees to be jointly and severally liable with the Principal CardMember for all said charges, fees, interest, late payment charges, legal and other costs and incidental expenses incurred by the Supplementary CardMember(s) and debited to the Line of Credit Account.
    c) The Supplementary CardMember hereby agrees and consents that the Line of Credit Provider may at all times without prejudice to and without discharging or in any way affecting the liability of the Supplementary CardMember hereunder:
    i) determine, vary, decrease or increase the Line of Credit Limit to the Principal CardMember and/or Supplementary CardMember(s);
    ii) vary or modify the Terms and Conditions of the use of the Line of Credit to the Supplementary CardMember(s);
    iii) grant to the Principal CardMember or any other Supplementary CardMember(s) or any other person(s) any time or indulgence;
    iv) deal with, exchange, release, modify or abstain from perfecting or enforcing any security or other guarantee or rights which the Line of Credit Provider may now or hereafter have from or against the CardMember or any other person;
    v) compound or compromise with the CardMember or guarantor or any other person.
    d) The Statement of Line of Credit Account of the Line of Credit Provider as to the monies and liability for the time being due or incurred by the Supplementary CardMember(s) to the Line of Credit Provider shall be conclusive evidence in any legal proceedings against the Supplementary CardMember(s).
    e) In the event of loss or theft of the CardMember's Card, the Line of Credit Provider may resolve that the CardMember's liabilities shall be limited to RM 250.00 for any debits to the Line of Credit Account arising from all transactions effected before receipt of notification to MBFC of such loss or theft, PROVIDED ALWAYS that the CardMember has taken all reasonable care and precaution to prevent the loss and/or theft of the Card or has not acted fraudulently and has informed MBFC or its agent promptly upon discovering that his Card is lost or stolen.

    Definitions   Terms and Conditions
    MBFC (ours, us and we) :

    MBF Cards (M’sia) Sdn. Bhd., a company incorporated in Malaysia and having its registered office at Menara MBf, Jalan Sultan Ismail, 50250, Kuala Lumpur and includes persons deriving title thereunder and its successors in titles and assigns.

    Card(s); MasterCard and/or Visa :

    Credit card(s) and/or charge card(s) issued by MBFC including to you as a Principal and/or Supplementary Cards.

    Principal Card :

    Card issued to the Principal CardMember.

    Supplementary Card(s) :

    Card(s) issued to approved nominees of the Principal CardMember.

    CardMember(s) :

    Any person who is issued a Card including Supplementary Card(s) by MBFC.

    Principal CardMember :

    The person who applied as the Principal Applicant and has been approved to hold a CardMember Principal Card.

    Principal Card :

    Card issued to the Principal CardMember.

    Supplementary CardMember :

    A person who is an approved nominee of the Principal CardMember under the account of a Principal CardMember and is or has been approved to hold a Supplementary Card issued by MBFC.

    PIN :

    Personal Identification Number issued to the CardMember and Supplementary CardMember(s) respectively.

    Establishment :

    The establishment or merchants, who have agreed to allow the purchase of goods and services to be charged to the Card.

    Statement of Account :

    The monthly statement issued by us in respect to the Retail and Other Transaction charges incurred by you with the use of the Card and/or subscription to MBF Bill Payment Service. At our absolute discretion, we may or may not send out any statement if there is no outstanding amount payable to us and there are no transactions in that particular month.

    Account :

    The CardMember(s) account with MBFC.

    Credit Card Number :

    The 16-digit number embossed on the card. This number may vary due to reasons such as (but not limited to) card replacements, card product changes and system requirements.

    Line of Credit Limit :

    The prescribed spending limit set by MBFC to the CardMember(s) and which amount shall be set by MBFC from time to time and notified by MBFC to the CardMember(s) in writing.

    Counters :

    Counters and/or other financial institutions that accept MasterCard and/or Visa for cash advance purposes.

    Minimum Repayment :

    The sum indicated in the Statement of Line of Credit Account as the minimum payment of the amount due to us from CardMember(s).

    Statement of Account Date :

    The date on which the Line of Credit Provider issue the Statement of Line of Credit Account.

    Line of Credit Due Date :

    The date on which CardMember(s) are to pay the total amount owing or the Minimum Repayment as stated in the Statement Line of Credit of Account.

    Notice Period :

    The notice period will be based on the stipulated time that is set by MBFC.

    Interest Free Period :

    The Interest Free Period refers to the period where no interest will be charged on retail transactions for 20 days between the statement date and the payment due date, provided that your previous month’s outstanding balance have been settled in full. If you opt to pay a partial or the minimum repayment amount from the previous statement, interest on your new retail transaction will be calculated from the day the transaction is posted to your card account.

    Posting Date :

    The date on which the transactions are posted to the CardMember(s) Line of Credit Account.

    Prescribed Rate :

    The interest payable under Clause 7.1 of Terms and Conditions.

    Retail and Other Transactions :

    The charges relating to purchases of goods, payments for services, cash advances, interest, late payment charges, fees, costs etc. incurred by CardMember(s) effected by the use of the Card including cash payment made by a Subscriber for his/her Bill OR request(s) given by CardMember(s) to MBFC to effect payment of Bill via MBF Bill Payment Service, MBF Cards Auto BILLPAY, CALL ’n PAY™, CLIK ’n PAY™ or mBILLPAY.

    Service Provider :

    Any corporation or party who has entered into an agreement with MBFC to allow payment of Bill(s) by subscriber(s) through MBF Cards Auto BILLPAY, CALL ’n PAY™, CLIK ’n PAY™ or mBILLPAY.

    Subscriber :

    Person (natural or otherwise) subscribing to goods or services provided by the Service Provider(s) and or their respective representative(s).

    Bill :

    The periodic bill(s) issued by the Service Provider(s) to persons (natural or otherwise) who have subscribed for the provision of utilities or service from the Service Provider(s).

    Working Day :

    Monday to Friday (excluding Public Holidays) on which MBFC Head Office is open for business.

    MBF Bill Payment Service :

    Refers to CALL’n PAY™ and/or CLIK’n PAY™ and/or MBF Cards Auto BILLPAY and/or mBILLPAY. The payment service provided by MBFC whereby CardMember authorises MBFC to settle Bill presented by Service Provider to MBFC by debiting CardMember’s Account.

    Card Issuer :

    Any bank or financial institution or body licensed to issue a Card.

    Tick Box :

    The expression “Tick Box” means a little box appearing on the web page for the user to tick on to signify acceptance of the Terms and Conditions governing the use of CLIK ’n PAY™.

    Approval Code :

    The code (alphabetical and/or numeric) given by MBFC to CardMember(s) confirming that the CardMember(s) request to effect payment of Bill(s), Retail and other transactions is successfully submitted to MBFC and approved accordingly by MBFC.

    3D Secure Services :

    Online authentication services catered for Visa and/or MasterCard to facilitate secure online transactions at participating 3D secure online merchants displaying the “VERIFIED by VISA (VbV)” logo and/or “MasterCard SecureCode” logo.


    Words implying singular number imply plural number and vice versa.

    Words implying a person also imply a partnership, firm or corporation.

    The heading to the Terms and Conditions hereof shall not be deemed to be a part thereof or to be taken into consideration in the interpretation or constructing thereof of these Terms and Conditions.

    For the purpose of calculating any period of time and where an act is required to be done within a certain period of time from a specified date the period inclusive of and time begins to run from the date so specified.

    Page 2, Clause 1.4

    1. Using Your Card and Your Limit

    1.1 You shall immediately place your signature at the back of the Card upon your receipt of the Card. Whether you sign at the Card or not, you are fully responsible for complying with these Terms and Conditions or other Terms and Conditions as we may prescribe from time to time, including the obligation to pay us for all balances due as per your Statement of Account.
       
    1.2 The use of your Card shall also be subject to prevailing terms, conditions and regulations of Bank Negara Malaysia and Foreign Exchange Administration Rules.
       
    1.3 The Card is not transferable and no other person except you shall be entitled to sign bills or transact with the designated merchants and financial institutions authorised to display Visa and/or MasterCard signage.
       
    1.4 At our discretion, we may revise the Limit at any time as we see fit. Any change in the Limit shall be communicated to you within the notice period, prior to the effective date of change.
       
    1.5 The total amount charged to your Account, including purchases, cash advances, finance charges, fees and other charges should be within the Limit. However, if that total amount exceeds the Limit, you must still pay to us all outstanding amount owing to us.
       
    1.6 We may at our absolute discretion approve any transactions which may or may not cause you to exceed the Limit without waiving our rights under this agreement.
       
    1.7 The MBF EPP Limit (subject to approval) is provided by MBF Cards for the purpose of purchase(s) made via MBF Cards XtremeDeals Program. If you fail to pay the full monthly MBF EPP installment, interest shall be imposed on the current balance amount under the MBF EPP program.

     

    Page 3, Clause 2.19

    2. Card

    2.1 The Card is and shall at all times remain our property and shall be surrendered to us immediately upon our request.
       
    2.2 We shall be entitled to at our absolute discretion to withhold or renew any Card.
       
    2.3 All charges, interest and debits set forth in the Statement of Account incurred by and/or in connection with the use of the Card must be paid to us.
       
    2.4 The CardMember shall not use the Card for any unlawful activities, including but not limited to illegal online betting and online gambling.
       
    2.5 If we do find that your Card number has been used for unlawful activity, we shall be entitled to terminate the use of your Card without prior notice.
       
    2.6 For the purpose of effecting any cash advances via the Automated Teller Machines (ATM), we will provide a PIN to you. We will issue and deliver the PIN to you at your own risk. We may, without in any way being obligated to do so, request you to collect the PIN personally.
       
    2.7 The PIN is strictly confidential and you shall not disclose the PIN to any person under any circumstances or by any means whatsoever. You are to be fully responsible and liable for all transactions effected by the use of the PIN whether with or without your knowledge.
       
    2.8 You shall forthwith notify us in writing of any changes in your or your Supplementary CardMember(s) residential address, telephone number or change of employment or business.
       
    2.9 You are to update your particulars at our request from time to time.
       
    2.10 You must undertake all reasonable care and precaution to prevent loss or theft of the Card.
       
    2.11 You are obligated to inform us, or if outside Malaysia, to inform any member institution, Visa International and/or MasterCard International (whichever is applicable) immediately to confirm in writing if the Card is lost or stolen. You must immediately lodge a police report and forward a copy of the report to us.
       
    2.12 If the Card reported lost/stolen is subsequently recovered, you shall return the Card cut in half and punch a hole on the chip to us immediately upon recovery.
       
    2.13 Your maximum liability for unauthorised transactions as a consequence for lost or stolen Card(s) shall be confined to a limit specified by us, which shall not exceed RM250, provided that you have not acted fraudulently or negligently and has informed us as soon as reasonably practicable after having found that your Card is lost or stolen.
       
    2.14 CardMember is liable for any unauthorised transactions if the CardMember has acted fraudulently or negligently or has failed to inform the issuer as soon as reasonably practicable upon discovery of the loss or theft of the CardMember’s credit card.
       
    2.15 All Cards are our property and may be withdrawn at any time at our discretion without prior notice and without assigning any reason thereof. You hereby expressly consent to us withdrawing the Card at such places and at such times as we deem fit, including being in the presence of or to the knowledge of other persons whether or not the Statement of Account is in credit or otherwise. Subsequently, you shall return to us all Cards cut in half and punch a hole on the chip issued to you, when asked to do so, even if the use of the Card was suspended or cancelled by you.
       
    2.16 Upon cancellation or withdrawal of the Card, the entire unpaid balance under the Statement of Account shall be immediately due and payable to us.
       
    2.17 You may terminate this agreement by returning the Card cut in half and punch a hole on the chip to MBFC. Until the Card is cut in half and punch a hole on the chip is received by us, your liabilities shall continue. Such termination shall be without prejudice to your obligation to pay to us all monies owing to us prior to the date of termination of this agreement.
       
    2.18 We may without prior notice at our sole discretion without any liability whatsoever deny any transaction charge using the Card(s) at any time and we are under no obligation to offer any explanation whatsoever for such denial.
       
    2.19 We may, at your request, but without being obligated to do so, reinstate the Card cancelled by us due to credit reason(s) and charge an administrative fee for each Card reinstated. We reserve rights to vary the administrative fee of RM50 from time to time and shall be communicated to you.

     

    Page 3, Clause 3.2

    3. Supplementary Cards

    3.1 As a Principal CardMember, you may request additional Card(s) to be issued for person or persons nominated by you to be an additional CardMember(s) (‘Supplementary CardMember(s)’) provided that you shall be responsible and liable for all charges, interest and debits incurred and in connection with the use of the Supplementary Card(s) notwithstanding that the Supplementary Card(s) may bear different credit card account numbers or have separate assigned limits.
       
    3.2 All Terms and Conditions of this agreement shall apply to the Supplementary CardMember(s) in relation to the Supplementary Card(s) save as otherwise provided in this agreement. The Supplementary CardMember(s) may be subject to all other Terms and Conditions as we may impose from time to time.
       
    3.3 The Supplementary Card may be cancelled at your request accompanied by the Card cut in half and punch a hole on the chip, provided that cancellation does not affect our rights and entitlement, duties and obligations accrued before said cancellation.
       
    3.4 Upon the termination of the Principal Card for whatever reason, the use of the Supplementary Card(s) shall forthwith also be terminated.

     

    Page 4, Clause 5.1

    5. Cash Advance

    5.1 Where applicable Cash Advances may be given at designated Automated Teller Machines (ATM) in Malaysia or such other countries as shall be approved from time to time or at designated offices or locations pursuant to Terms and Conditions for Cash Advance made between you and us. You shall pay us a Cash Advance fee of 5% of the amount advanced or RM15.00 (whichever is higher). The Cash Advance fee may be varied from time to time and shall be communicated to you by giving prior notice. All quasi-cash transactions which include but not limited to purchase of lottery tickets and chips at gaming casinos, off-track betting and wagers at race tracks will be treated as Cash Advance transactions and the relevant Cash Advance fees and finance charges will apply.
       
    5.2 We reserve the right to determine the total amount of cash advances withdrawn by you, the amount of which may be lower than the limit assigned to you at anytime.
       
    5.3 Principal CardMembers are allowed to withdraw cash advance of up to 70% of the available credit limit.

     

    Page 5, Clause 8.1 (a) and 8.1 (b)

    8. Card Issued on Condition of CardMember’s Placing a Fixed Deposit With A Line of Credit Provider

    8.1

    In the event that the CardMember (including any Supplementary CardMember) holds the Card by virtue of the Principal CardMember having a fixed deposit account with the Line of Credit Provider, then the CardMember agrees:

    a) that the Principal CardMember must at all times maintain with the Line of Credit Provider a minimum balance in the fixed deposit account, in the Principal CardMember’s name. The minimum balance in the fixed deposit account shall be determined from time to time by the Line of Credit Provider. Such changes shall take effect after the notice period.
       
    b) if at any time the Principal CardMember’s balance in the fixed deposit account falls below the required minimum balance in the fixed deposit account, the Line of Credit Provider shall withdraw the Line of Credit after the notice period to the CardMember(s).

     

    Page 6, Clause 13.2

    13. Variation of Agreement

    13.1 We may from time to time amend, add or vary the Terms and Conditions including the terms of payment. We shall notify you of such variations by way of messages on your Statement of Account. Notwithstanding the above, the prevailing Terms and Conditions can always be obtained from our website or upon request from our branches. Such changes shall take effect within the notice period.
       
    13.2 If you do not accept the prevailing Terms and Conditions as from the date on which such changes came into effect, you must notify us promptly by written notice and return the Card cut into half and punch a hole on the chip and you must make full settlement on all outstanding balance in your account.
       
    13.3 The retention or use of your Card after the effective date of any variation, revision or change of Terms and Conditions shall be deemed to constitute acceptance of such variation, revision or change without any reservation by you.

     

    Page 6, Clause 16.2

    16. Termination

    16.1 All monies due and owing by you hereunder shall at our demand become immediately due and payable without prior notice upon any of the following occurrences:
       
     
    a) you failing to perform and/or to observe any of the Terms and Conditions herein.
       
    b) us suspending, terminating, or withdrawing your rights to use the Card..
       
    c) in the event of your death or you become insolvent, committing an act of bankruptcy or in the case of you being a company, a petition is presented for your winding up or a resolution is passed for your voluntary winding up.
       
    d) you failing to pay any other indebtedness owed to us when due.
       
    e) if in our opinion, your account (including any other account you may have with any other institution) is or has not been operated satisfactorily and/or if you commit or threaten to commit a default of any provision of any agreement, or security documents, or both (as the case may be), relating to other accounts or loan facilities granted by us or any other institutions to you or other party in which you are a guarantor, or chargor or assignor.
       
    f) any order for execution, writ of attachment, garnishment, or any other legal proceeding is issued against you.
       
    g) an event has occurred or a situation exists which could or might in our sole and absolute opinion:
       
     
    i) prejudice your ability to perform your obligation herein or
       
    ii) prejudice the repayment of the amount due and payable to us or the Minimum Repayment under the Statement of Account.

    16.2 Notwithstanding the above, upon termination of the Card(s), any credit balance below RM5.00 shall be debited by MBFC as petty balance adjustment.

     

    Page 7, Clause 23.1

    23. Consolidation

    23.1 We may at anytime by giving at least 7 calendar days prior notice to you, combine or consolidate all or any of the accounts you may have with us and set-off or transfer any sum(s) standing to the credit of any one or more of such accounts in or towards satisfaction of all or any of your liabilities to us.

    29. Miscellaneous

    29.1 Your obligation as a CardMember shall be binding on personal representatives, heirs assigns and successors in your title.
       
    29.2 At our sole discretion, we are authorised by you to convert your charge card to a credit card or vice versa and/or transfer fully or partially the closing balance as shown on your Statement of Account between the two cards.
       
    29.3 All fees and disbursement shall not be refundable.
       
    29.4 CardMembers are allowed to choose to enter into a contract either in English or Bahasa Malaysia version. The contract signed in that language will be the contract exhibited in the Court of Law.

    Definitions   Terms and Conditions
    MBFC (ours, us and we) :

    MBF Cards (M’sia) Sdn. Bhd., a company incorporated in Malaysia and having its registered office at Menara MBf, Jalan Sultan Ismail, 50250 Kuala Lumpur and includes persons deriving title thereunder and its successors in titles and assigns.

    Line of Credit Provider :

    Banks, finance companies and other companies endorsed by MBFC to provide a Line of Credit to the CardMember including but not limited to the following: AmBank (M) Berhad, a company incorporated in Malaysia and having its registered office at Level 30, Menara AmBank, Jalan Yap Kwan Seng, 50450 Kuala Lumpur.

    Card(s); MasterCard and/or Visa :

    Credit Card(s) and/or Charge Card(s) issued by MBFC including to you as a Principal and/or Supplementary Card(s).

    Principal Card :

    Card issued to the Principal CardMember.

    Supplementary Card(s) :

    Card(s) issued by MBFC to approved nominee(s) of the Principal CardMember under the account of the Principal CardMember.

    CardMember(s) :

    Any person who is issued a Card (including any Supplementary Card(s)) by MBFC.

    Principal CardMember :

    A person who has been approved to hold a basic Card issued by MBFC.

    Supplementary CardMember :

    A person who is an approved nominee of the Principal CardMember under the account of a Principal CardMember and is or has been approved to hold a Supplementary Card issued by MBFC.

    PIN :

    Personal Identification Number issued to the CardMember and Supplementary CardMember(s) respectively.

    Establishment :

    The establishment or merchants which have agreed to allow the purchase of goods and services to be charged to the Cards.

    Charge Account :

    The CardMember’s account with MBFC which facilitates charges incurred over and above the Line of Credit Limit (where applicable).

    Statement of Account :

    The monthly statement issued by MBFC in respect of charges incurred by the CardMember with the use of the Card. MBFC at its absolute discretion may or may not send out any statement if there is no outstanding amount payable to MBFC and there are no transactions for any particular month.

    Account :

    The CardMember(s) account with MBFC.

    Credit Card Number :

    The 16-digit number embossed on the Card. This number may vary due to reasons such as (but not limited to) Card replacements, Card product changes and system requirements.

    Line of Credit :

    The facility made available by the Line of Credit Provider to the CardMember upon the Terms and Conditions set out under the heading “Terms and Conditions on Line of Credit offered by Line of Credit Provider”.

    Line of Credit Agreement :

    The Agreement made between the Line of Credit Provider and CardMember for the Line of Credit as set out in this booklet under the heading “Terms and Conditions on Line of Credit offered by Line of Credit Provider” subject to such amendments as the Line of Credit Provider may prescribe from time to time.

    Line of Credit Limit :

    The prescribed spending limit set by the Line of Credit Provider to the CardMember and which amount shall be set by the Line of Credit Provider from time to time and notified by either the Line of Credit Provider or MBFC to the CardMember in writing.

    Minimum Repayment :

    The sum indicated in the Statement of Line of Credit Account as the minimum amount due from the CardMember.

    Statement of Line of Credit Account :

    The monthly statement issued by MBFC jointly with the Line of Credit Provider in respect of Credit Account of the amounts owing under the Line of Credit Account given to the CardMember. The Line of Credit Provider at its absolute discretion may or may not send out any statement if there is no outstanding amount payable to the Line of Credit Provider and there are no transactions for any particular month.

    Statement of Account Date :

    The date on which the Line of Credit Provider issues the Statement of Line of Credit Account and/or the date on which MBFC issues the Statement of Charge Account (or Card Account) either jointly or severally whichever is applicable.

    Line of Credit Due Date :

    The date on which the CardMember is to pay the total amount owing or the Minimum Repayment as stated in the Statement of Line of Credit Account.

    Notice Period :

    The notice period will be based on the stipulated time that is set by MBFC and/or Line of Credit Provider.

    Interest Free Period :

    The Interest Free Period refers to the period where no interest will be charged on retail transactions for 20 days between the statement date and the payment due date, provided that your previous month’s outstanding balance has been settled in full. If you opt to pay a partial or the minimum repayment amount from the previous statement, interest on your new retail transaction will be calculated from the day the transaction is posted to your Card account.

    Posting Date :

    The date on which the transactions are posted to the CardMember’s Line of Credit Account.

    Prescribed Rate :

    The interest payable under Clause 15 of the “Terms and Conditions on Line of Credit offered by Line of Credit Provider”.

    Retail and Other Transactions :

    The charges relating to purchases of goods, payment for services, cash advances, interest, late payment charges, fees, costs, etc. incurred by CardMember effected by use of the Card including cash payment made by a Subscriber for his/her Bill OR request(s) given by CardMember to MBFC to effect payment of Bill via MBF Cards Bill Payment Service, MBF Cards Auto BILLPAY, CALL’n PAY™, CLIK’n PAY™ and mBILLPAY.

    Service Provider :

    Any corporation or party which has entered into an agreement with MBFC to allow payment of Bill(s) by subscriber(s) through MBF Cards Auto BILLPAY, CALL’n PAY™, CLIK’n PAY™ and mBILLPAY.

    Subscriber :

    Person (natural or otherwise) subscribing to the goods or services provided by the Service Provider(s) and or their respective representative(s).

    Bill :

    The periodic bill(s) issued by the Service Provider(s) to people (natural or otherwise) who have subscribed for the provision of utilities or services from the Service Provider(s).

    Working Day :

    TERMS AND CONDITIONS GOVERNING THE USE OF THE CARD

    Page 3, Clause 1 (a)

    1. Conditions of Use of the Card

    1.1 In consideration of MBFC making available facilities of the Card to the CardMember, the CardMember agrees to abide by these Terms and Conditions and such other Terms and Conditions as MBFC may prescribe from time to time. The CardMember agrees to sign on the signature panel of the Card immediately upon receipt of the Card. The CardMember agrees:
       
     
    a) that the Card is not transferable and only the CardMember shall be entitled to sign bills or transact on the Card with designated establishments or financial institutions authorised to display the MasterCard, Visa and other brands decal prescribed from time to time;
       
    b) to pay MBFC all charges and debits set forth in the Statement of Charge Account incurred by the use of the Card or any Supplementary Cards and where a Line of Credit is granted to the CardMember, to pay to the Line of Credit Provider the full amount under the Line of Credit or the Minimum Repayment specified in the Statement of Line of Credit Account or such monies payable to the Line of Credit Provider in accordance with the Terms and Conditions of the Line of Credit Agreement;
       
    c) that the Card shall not be used for any unlawful activities, including but not limited to illegal online betting or gambling. MBFC may terminate the use of the Card if the CardMember is found to have used the Card for such activity;
       
    d) to pay MBFC in full all costs incurred including legal fees on a solicitor and client basis and disbursements in recovering monies under the Statement of Charge Account;
       
    e) to authorise MBFC to send the PIN by post at the CardMember’s risk. MBFC may, without in any way being held to be obligated to do so, request the CardMember to collect the PIN personally;
       
    f) to exercise all possible care to ensure the safety of the Card and prevent the PIN becoming known to any other person. The PIN is to be kept confidential at all times and not to be revealed to the CardMember’s spouse, family members or any other person whatsoever;
       
    g) to be fully responsible and liable for all transactions effected by the use of the PIN whether with or without the knowledge or authority of the CardMember;
       
    h) to advise MBFC promptly in writing of any changes of the CardMember’s and Supplementary CardMember’s residential address, telephone number or change of employment or business of the CardMember or Supplementary CardMember;
       
    i) to update the CardMember’s particulars at MBFC’s request from time to time.

The minimum balance in the fixed deposit account shall be determined from time to time by the Line of Credit Provider. Such changes shall take effect after the notice period.
       
    b) if at any time the Principal CardMember’s balance in the fixed deposit account falls below the required minimum balance in the fixed deposit account the Line of Credit Provider shall withdraw the Line of Credit after the notice period to the CardMember(s).

     

    Page 4 – 5, Clause 17 (a)

    17. Cash Advance

    17.1

    6. Withdrawal

    6.1 In the event that the CardMember (including any Supplementary CardMember) holds the Card by virtue of the Principal CardMember having a fixed deposit account with the Line of Credit Provider, then the CardMember agrees:
       
     
    a) that the Principal CardMember must at all times maintain with the Line of Credit Provider a minimum balance in the fixed deposit account, in the Principal CardMember’s name. The minimum balance in the fixed deposit account shall be determined from time to time by the Line of Credit Provider. Such changes shall take effect after the notice period.
       
    b) if at any time the Principal CardMember’s balance in the fixed deposit account falls below the required minimum balance in the fixed deposit account, the Line of Credit Provider shall withdraw the Line of Credit after the notice period to the CardMember(s).

    14. Line of Credit Provider’s review

    14.1 The Line of Credit Provider has the absolute discretion to review from time to time the Line of Credit granted to a CardMember and the Line of Credit Provider may at any time and from time to time at its absolute discretion by giving prior notice determine, vary, decrease or increase CardMember’s Line of Credit. The Line of Credit Provider may also at any time and from time to time at its absolute discretion without giving prior notice, suspend or terminate CardMember’s Line of Credit.

    21. Consolidation

    21.1 The Line of Credit Provider may at any time by giving at least 7 calendar days prior notice to the CardMember, combine or consolidate all or any of the accounts including deposit and saving accounts the CardMember may have with the Line of Credit Provider and set-off or transfer any sum or sums standing to the credit of any one or more of such accounts in or towards satisfaction of all or any of the CardMember’s liabilities to the Line of Credit Provider.

    27. Variation

    27.1
    a) The Line of Credit Provider may change, amend, add or vary these Terms and Conditions including the terms of repayment at any time and from time to time by written notice to the Principal CardMember in the manner provided by Clause 37. Such changes shall take effect on the date stated in the notice.
       
    b) If the CardMember does not accept any changes to these Terms and Conditions within the notice period, the CardMember must discontinue using the Card as from the date on which such changes come into effect and shall notify the Line of Credit Provider thereof promptly by written notice and return the Card cut in half and punch a hole on the chip and the CardMember must make full settlement on all outstanding balance in their account.
       
    c) If the CardMember uses the Card after the date on which the notice of any change in these Terms and Conditions is to take effect, the CardMember shall be deemed to have accepted and agreed to such changes without reservations.
       
    d) Any statements or notice referred to in these conditions shall be deemed to have been received by the CardMember after postage to the CardMember’s last known address.

    31. Line of Credit Provider’s Discretion

    31.1 The Line of Credit Provider shall be entitled at its absolute discretion and at any time to disburse or withhold disbursement or to allow partial disbursement of any drawdown of the Line of Credit or to refuse to allow any disbursement at all or to suspend or terminate the Line of Credit. Notwithstanding the above, after termination of CardMember’s Line of Credit, any credit balance below RM5.00 shall be debited by the Line of Credit Provider as petty balance adjustment.
  20. Changes on the CardMember’s Terms and Conditions 23rd June 2011

    With Reference to the Bank Negara Malaysia (BNM) new guidelines, kindly be informed that MBF Cards has made changes to the CardMember’s Terms and Conditions for below mentioned clauses.

    Please note that these changes will take effect twenty one (21) days from the above notice date.

    In the event of conflict/ambiguities of any translated versions of the Terms and Conditions (including but not limited to Bahasa Malaysia) with the English version, the CardMember shall refer to the English version and the English version shall prevail.

    Page 2, Clause 1.1 and 1.4

    1. Using Your Card and Your Limit

    1.1 You shall immediately place your signature at the back of the Card upon your receipt of the Card. Whether you sign at the Card or not, you are fully responsible for complying with these Terms and Conditions or other Terms and Conditions as we may prescribe from time to time within the notice period, including the obligation to pay us for all balances due as per your Statement of Account.
       
    1.2 The use of your Card shall also be subject to prevailing terms, conditions and regulations of Bank Negara Malaysia and Foreign Exchange Administration Rules.
       
    1.3 The Card is not transferable and no other person except you shall be entitled to sign bills or transact with the designated merchants and financial institutions authorised to display Visa and/or MasterCard signage.
       
    1.4 At our discretion, we may revise the Limit at any time as we see fit. Any change in the Limit shall be communicated to you within the notice period, prior to the effective date of change.
       
    1.5 The total amount charged to your Account, including purchases, cash advances, finance charges, fees and other charges should be within the Limit. However, if that total amount exceeds the Limit, you must still pay to us all outstanding amounts owing to us.
       
    1.6 We may at our absolute discretion approve any transactions which may or may not cause you to exceed the Limit without waiving our rights under this agreement.
       
    1.7 The MBF EPP Limit (subject to approval) is provided by MBF Cards for the purpose of purchase(s) made via MBF Cards XtremeDeals Program. If you fail to pay the full monthly MBF EPP installment, interest shall be imposed on the current balance amount under the MBF EPP program.

    2. Card

    2.1 The Card is and shall at all times remain our property and shall be surrendered to us immediately upon our request.
       
    2.2 We shall be entitled to at our absolute discretion to withhold or renew any Card.
       
    2.3 All charges, interest and debits set forth in the Statement of Account incurred by and/or in connection with the use of the Card must be paid to us.
       
    2.4 The CardMember shall not use the Card for any unlawful activities, including but not limited to illegal online betting and online gambling.
       
    2.5 If we do find that your Card number has been used for unlawful activity, we shall be entitled to terminate the use of your Card without prior notice.
       
    2.6 For the purpose of effecting any cash advances via the Automated Teller Machines (ATM), we will provide a PIN to you. We will issue and deliver the PIN to you at your own risk. We may, without in any way being obligated to do so, request you to collect the PIN personally.
       
    2.7 The PIN is strictly confidential and you shall not disclose the PIN to any person under any circumstances or by any means whatsoever. You are to be fully responsible and liable for all transactions effected by the use of the PIN whether with or without your knowledge.
       
    2.8 You shall forthwith notify us in writing of any changes in your or your Supplementary CardMember(s) residential address, telephone number or change of employment or business.
       
    2.9 You are to update your particulars at our request from time to time.
       
    2.10 You must undertake all reasonable care and precaution to prevent loss or theft of the Card.
       
    2.11 You are obligated to inform us, or if outside Malaysia, to inform any member institution, Visa International and/or MasterCard International (whichever is applicable) immediately to confirm in writing if the Card is lost or stolen. You must immediately lodge a police report and forward a copy of the report to us.
       
    2.12 If the Card reported lost/stolen is subsequently recovered, you shall return the Card cut in half and punch a hole on the chip to us immediately upon recovery.
       
    2.13 Your maximum liability for unauthorised transactions as a consequence for lost or stolen Card(s) shall be confined to a limit specified by us, which shall not exceed RM250, provided that you have not acted fraudulently or negligently and has informed us as soon as reasonably practicable after having found that your Card is lost or stolen.
       
    2.14 CardMember is liable for any unauthorised transactions if the CardMember has acted fraudulently or negligently or has failed to inform the issuer as soon as reasonably practicable upon discovery of the loss or theft of the CardMember´s credit card.
       
    2.15 All Cards are our property and may be withdrawn at any time at our discretion without prior notice and without assigning any reason thereof. You hereby expressly consent to us withdrawing the Card at such places and at such times as we deem fit, including being in the presence of or to the knowledge of other persons whether or not the Statement of Account is in credit or otherwise. Subsequently, you shall return to us all Cards cut in half and punch a hole on the chip issued to you, when asked to do so, even if the use of the Card was suspended or cancelled by you.
       
    2.16 Upon cancellation or withdrawal of the Card, the entire unpaid balance under the Statement of Account shall be immediately due and payable to us.
       
    2.17 You may terminate this agreement by returning the Card cut in half and punch a hole on the chip to MBFC. Until the Card is cut in half and punch a hole on the chip is received by us, your liabilities shall continue. Such termination shall be without prejudice to your obligation to pay to us all monies owing to us prior to the date of termination of this agreement.
       
    2.18 We may without prior notice at our sole discretion without any liability whatsoever deny any transaction charge using the Card(s) at any time and we are under no obligation to offer any explanation whatsoever for such denial.
       
    2.19 We may, at your request, but without being obligated to do so, reinstate the Card cancelled by us due to credit reason(s) and charge an administrative fee for each Card reinstated. We reserve the rights to vary the administrative fee of RM50 from time to time and shall be communicated to you within the notice period prior to the effective date of the change.

    3. Supplementary Cards

    3.1 As a Principal CardMember, you may request additional Card(s) to be issued for person or persons nominated by you to be an additional CardMember(s) (‘Supplementary CardMember(s)’) provided that you shall be responsible and liable for all charges, interest and debits incurred and in connection with the use of the Supplementary Card(s) notwithstanding that the Supplementary Card(s) may bear different credit card account numbers or have separate assigned limits.
       
    3.2 All Terms and Conditions of this agreement shall apply to the Supplementary CardMember(s) in relation to the Supplementary Card(s) save as otherwise provided in this agreement. The Supplementary CardMember(s) may be subject to all other Terms and Conditions as we may impose within the notice period.
       
    3.3 The Supplementary Card may be cancelled at your request accompanied by the Card cut in half and punch a hole on the chip, provided that cancellation does not affect our rights and entitlement, duties and obligations accrued before said cancellation.
       
    3.4 Upon the termination of the Principal Card for whatever reason, the use of the Supplementary Card(s) shall forthwith also be terminated.

    5. Cash Advance

    5.1 Where applicable Cash Advances may be given at designated Automated Teller Machines (ATM) in Malaysia or such other countries as shall be approved from time to time or at designated offices or locations pursuant to Terms and Conditions for Cash Advance made between you and us. You shall pay us a Cash Advance fee of 5% of the amount advanced or RM15.00 (whichever is higher). The Cash Advance fee may be varied from time to time and shall be communicated to you within the notice period prior to the effective date of the change. All quasi-cash transactions which include but not limited to purchase of lottery tickets and chips at gaming casinos, off-track betting and wagers at race tracks will be treated as Cash Advance transactions and the relevant Cash Advance fee and finance charges will apply.
       
    5.2 We reserve the right to determine the total amount of cash advances withdrawn by you, the amount of which may be lower than the limit assigned to you at anytime.
       
    5.3 Principal CardMembers are allowed to withdraw cash advance of up to 70% of the available credit limit.

     

    Page 5, Clause 7.8

    7. Credit Card Interest

    7.1 The Prescribed Rate will be the interest rate reflected in the Statement of Account. We shall be entitled at our absolute discretion by giving notice to you as the Principal CardMember, vary the Prescribed Rate at any time. Interest at the Prescribed Rate is also payable on the judgement sum after the date of any judgement obtained against you.
       
    7.2 Notwithstanding any other provision herein, you shall, where applicable, pay to us the interest at the Prescribed Rate for all cash advances from the date of cash advance until full payment is received by us and credited into your Card Account.
       
    7.3

    Interest at the Prescribed Rate shall be computed as follows:

    a) Interest is calculated on any outstanding cash advance balance commencing from the date of disbursement until full settlement.
       
    b) Interest is imposed on any outstanding Retail & other Transactions that are not paid by the due date immediately following the statement date in which the transactions were posted, commencing from the due date until full settlement.
       
    c) No interest is imposed if balance of Retail & other Transactions from the previous month´s statement are settled in full by the due date.
       
    d) The tiered interest rates apply to cash Advance and generic Balance Transfer program unless stated otherwise.
       
    e) Tiered Interest Rate Categories shall be :

       10 or 11 months 1.42% 17%

    Note: The Tiered Interest Rate does not apply to Cash Advance Transaction which is 18% p.a.

    7.4 Interest at the Prescribed Rate shall be charged on the transaction referred to in Clauses 7.2 and 7.3 above, and shall continue to be charged and payable by you until full payment is received by us and credited into your Statement of Account.
       
    7.5 Interest on any Retail and other Transactions and/or cash advance transactions, late payment interest and all costs, charges and incidental expenses shall on the Statement of Account date be capitalised and added for all purposes to the total outstanding amount then owing and shall thereafter bear interest at the Prescribed Rate.
       
    7.6 The obligation to pay interest at the Prescribed Rate and late payment interest are independent obligations and accordingly shall be applicable whether before or after judgement, and shall not merge with the judgement.
       
    7.7 If you default in the payment of the Minimum Repayment, you shall in addition and without prejudice to our rights and the remedies which we may have under this Agreement, pay to us the late payment interest rate of one per cent (1%) of the total balance outstanding as at your statement date or a minimum of RM10, whichever is higher (up to a maximum of RM100).
       
    7.8 Upon termination of your Card, you shall in addition and without prejudice to the power, rights and remedies of us, including but not limited to the right to recover the total amount owing to us, interest at the Prescribed Rate and late payment interest pursuant to Clause 7.7 above, pay us late payment interest at the rate of one per cent (1%) per month or such other rate as we may prescribe from time to time within the notice period on the total amount owing by you under your Account.

    8. Card Issued on Condition of CardMember’s Placing a Fixed Deposit With A Line of Credit Provider

    8.1

    Without prejudice to any of the provisions of these Terms and Conditions, in the event that the CardMember (including any Supplementary CardMember) holds the Card by virtue of the CardMember having a RM50,000.00 fixed deposit account with a Line of Credit Provider endorsed by MBFC, then the CardMember (including any Supplementary CardMember) agrees as a condition of use:

    a) that the CardMember must at all times maintain with the Line of Credit Provider endorsed by MBFC a minimum balance of Ringgit Malaysia Fifty Thousand (RM50,000.00) in the fixed deposit account, in the CardMember’s name; OR
       
    b) if at any time the CardMember’s balance in the fixed deposit account falls below the required minimum of Ringgit Malaysia Fifty Thousand (RM50,000.00), MBFC may withdraw the use of the Card(s) with immediate effect, within notice period to the CardMember.

     

    Page 6, Clause 13.1

    13. Variation of Agreement

    13.1 We may from time to time amend, add or vary the Terms and Conditions including the terms of payment. We shall notify you of such variations by way of messages on your Statement of Account. Notwithstanding the above, the prevailing Terms and Conditions can always be obtained from our website or upon request from our branches. Such changes shall take effect within the notice period.
       
    13.2 If you do not accept the prevailing Terms and Conditions as from the date on which such changes came into effect, you must notify us promptly by written notice and return the Card cut into half and punch a hole on the chip.
       
    13.3 The retention or use of your Card after the effective date of any variation, revision or change of Terms and Conditions shall be deemed to constitute acceptance of such variation, revision or change without any reservation by you.
       

     

    Page 6, Clause 15.1

    15. Refusal

    15.1 Notwithstanding any provisions herein, we may at our sole and absolute discretion, at any time without prior notice decide not to renew, cancel, revoke the Card, or suspend or restrict the use of the Card whereupon monies owing to us shall become due and payable immediately in full upon the happening of the following events or any of them:
       
     
    i) failure to pay any monies owing to us under these Terms and Conditions;
       
    ii) if you are in breach of any of the provisions of these Terms and Conditions;
       
    iii) your account is suspended, terminated or withdrawn;
       
    iv) an event has occurred or a situation relating to you which could or might in our opinion prejudice the repayment of any monies owing by you to us.

    16. Termination

    16.1 All monies due and owing by you hereunder shall at our demand become immediately due and payable without prior notice upon any of the following occurrences:
       
     
    a) you failing to perform and/or to observe any of the Terms and Conditions herein.
       
    b) us suspending, terminating, or withdrawing your rights to use the Card.
       
    c) in the event of your death or you become insolvent, committing an act of bankruptcy or in the case of you being a company, a petition is presented for your winding up or a resolution is passed for your voluntary winding up.
       
    d) you failing to pay any other indebtedness owed to us when due.
       
    e) if in our opinion, your account (including any other account you may have with any other institution) is or has not been operated satisfactorily and/or if you commit or threaten to commit a default of any provision of any agreement, or security documents, or both (as the case may be), relating to other accounts or loan facilities granted by us or any other institutions to you or other party in which you are a guarantor, or chargor or assignor.
       
    f) any order for execution, writ of attachment, garnishment, or any other legal proceeding is issued against you.
       
    g) an event has occurred or a situation exists which could or might in our sole and absolute opinion:
       
     
    i) prejudice your ability to perform your obligation herein or
       
    ii) prejudice the repayment of the amount due and payable to us or the Minimum Repayment under the Statement of Account.


    16.2 Notwithstanding the above, upon termination of the Card(s), any credit balance below RM5.00 shall be absorbed by us as petty balance adjustment.

    18. Collection Agent

    18.1 We shall be entitled to appoint an agent to collect all sums due to us from you hereunder and we shall be entitled in our absolute discretion to disclose to the Agent pertaining to your account to facilitate the collection of all sums due and owing to us by you.

    23. Consolidation

    23.1 We may at anytime by giving at least 7 calendar days prior notice to you, combine or consolidate all or any of the accounts you may have with us and set-off or transfer any sum(s) standing to the credit or any one or more of such accounts in or towards satisfaction of all or any of your liabilities to us.

    24. Assignment

    24.1 We shall be entitled at any time without your consent to assign the whole or any part of our rights and obligations under these Terms and Conditions within the notice period to you.
       
    24.2 We have the right to sell or assign your account and all monies due to us to third parties.

    29. Miscellaneous

    29.1 Your obligation as a CardMember shall be binding on personal representatives, heirs assigns and successors in your title.
       
    29.2 At our sole discretion, we are authorised by you to convert your charge card to a credit card or vice versa and/or transfer fully or partially the closing balance as shown on your Statement of Account between the two cards.
       
    29.3 All fees and disbursement shall not be refundable.
       
    29.4 CardMembers are allowed to choose to enter into a contract either in English or Bahasa Malaysia version. The contract signed in that language will be the contract exhibited in the Court of Law.

    TERMS AND CONDITIONS GOVERNING THE USE OF THE CARD
    Conditions of Use of the Card

    1. In consideration of MBFC making available facilities of the Card to the CardMember, the CardMember agrees to abide by these Terms and Conditions and such other Terms and Conditions as MBFC may prescribe from time to time within the notice period. The CardMember agrees to sign on the signature panel of the Card immediately upon receipt of the Card. The CardMember agrees:
     
    a) that the Card is not transferable and only the CardMember shall be entitled to sign bills or transact on the Card with designated establishments or financial institutions authorised to display the MasterCard, Visa and other brands decal prescribed from time to time within the notice period;
       
    b) to pay MBFC all charges and debits set forth in the Statement of Charge Account incurred by the use of the Card or any Supplementary Cards and where a Line of Credit is granted to the CardMember, to pay to the Line of Credit Provider the full amount under the Line of Credit or the Minimum Repayment specified in the Statement of Line of Credit Account or such monies payable to the Line of Credit Provider in accordance with the Terms and Conditions of the Line of Credit Agreement;
       
    c) that the Card shall not be used for any unlawful activities, including but not limited to illegal online betting or gambling. MBFC may terminate the use of the Card if the CardMember is found to have used the Card for such activity;
       
    d) to pay MBFC in full all costs incurred including legal fees on a solicitor and client basis and disbursements in recovering monies under the Statement of Charge Account;
       
    e) to authorise MBFC to send the PIN by post at the CardMember’s risk. MBFC may, without in any way being held to be obligated to do so, request the CardMember to collect the PIN personally;
       
    f) to exercise all possible care to ensure the safety of the Card and prevent the PIN becoming known to any other person. The PIN is to be kept confidential at all times and not to be revealed to the CardMember’s spouse, family members or any other person whatsoever;
       
    g) to be fully responsible and liable for all transactions effected by the use of the PIN whether with or without the knowledge or authority of the CardMember;
       
    h) to advise MBFC promptly in writing of any changes of the CardMember’s and Supplementary CardMember’s residential address, telephone number or change of employment or business of the CardMember or Supplementary CardMember;
       
    i) to update the CardMember’s particulars at MBFC’s request from time to time.
       

     

    Page 3, Clause 3(b)

    Card Issued on Condition of CardMember’s Placing a Fixed Deposit with a Line of Credit Provider

    3.

    Withdrawal/Denial of Use of the Card

    a) All Cards issued are the property of MBFC and may be withdrawn at any time at the discretion of MBFC without prior notice and without assigning any reason thereof. The CardMember hereby expressly consents to MBFC withdrawing the Card at such places and at such times as MBFC deems fit including being in the presence of or to the knowledge of other persons whether or not the Statement of Charge Account is in credit or otherwise. The CardMember shall return to MBFC all Cards cut in half and punch a hole on the chip issued to the CardMember, when asked to do so or if the use of the Card by the CardMember is suspended or cancelled.
       
    b) Upon withdrawal of the use of the Card, the entire unpaid balance under the Statement of Charge Account shall be immediately due and payable.
       
    b) The CardMember may terminate this Agreement by returning the Card cut in half and punch a hole on the chip to MBFC and until the Card is cut in half and punch a hole on the chip is received, the liabilities of the CardMember and the Supplementary CardMembers shall continue. Such termination shall be without prejudice to the liabilities of the CardMember and the Supplementary CardMembers for all monies owing to MBFC prior to the date of termination.
       
    b) MBFC may without prior notice at its sole discretion without any liability whatsoever deny any charges at any time and MBFC is under no obligation to offer any explanation whatsoever for such denial.

    Cash Advance

    17.

MBFC reserves right to vary the administrative fee from time to time or anytime and shall be communicated to CardMember within the notice period prior to the effective date of the change.

    6. Withdrawal
    In the event that the CardMember (including any Supplementary CardMember) holds the Card by virtue of the Principal CardMember having a RM50,000 fixed deposit account with the Line of Credit Provider, then the CardMember agrees:
     
    a) that the Principal CardMember must at all times maintain with the Line of Credit Provider a minimum balance of Ringgit Malaysia Fifty Thousand (RM50,000) in the fixed deposit account, in the Principal CardMember’s name or such other minimum balance as the Line of Credit Provider may determine from time to time. Such changes shall take effect after the notice period.
       
    b) if at any time the Principal CardMember’s balance in the fixed deposit account falls below the required minimum of Ringgit Malaysia Fifty Thousand (RM50,000), the Line of Credit Provider shall withdraw the Line of Credit after the notice period to the CardMember(s).

    14.
    Line of Credit Provider’s Review
    The Line of Credit Provider has the absolute discretion to review from time to time the Line of Credit granted to a CardMember and the Line of Credit Provider may at any time and from time to time at its absolute discretion determine, vary, decrease or increase, suspend or terminate the Line of Credit without prior notice.

    17.
    Payment Interest in Default of Minimum Repayment
    If the Principal CardMember defaults in the payment of the Minimum Repayment by the Line of Credit Due date, the CardMember shall in addition and without prejudice to our rights and the remedies which we may have under this Agreement, pay to us the late payment interest rate of one percent (1%) of the total balance outstanding as at your statement date or a minimum of RM5, whichever is higher (up to a maximum of RM50).
     
    18.
    Late Payment Interest upon Termination
    Upon termination of the CardMember’s Line of Credit, the CardMember shall in addition and without prejudice to the power, rights and remedies of the Line of Credit Provider, including but not limited to the right to recover the total amount owing under the Line of Credit, interest at the Prescribed Rate and late payment interest pursuant to Clause 17 above, pay the Line of Credit Provider late payment interest at the rate of one percent (1%) per annum or such other rate as the Line of Credit Provider may prescribe from time to time within the notice period on the total amount owing by the CardMember under the Line of Credit.

    21.
    Consolidation
    The Line of Credit Provider may at any time by giving at least 7 calendar days prior notice to the CardMember, combine or consolidate all or any of the accounts including deposit and saving accounts the CardMember may have with the Line of Credit Provider and set-off or transfer any sum or sums standing to the credit of any one or more of such accounts in or towards satisfaction of all or any of the CardMember’s liabilities to the Line of Credit Provider.

    27. Variation
     
    a) The Line of Credit Provider may change, amend, add or vary these Terms and Conditions including the terms of repayment at any time and from time to time by written notice to the Principal CardMember in the manner provided by Clause 37. Such changes shall take effect on the date stated in the notice.
       
    b) If the CardMember does not accept any changes to these Terms and Conditions within the notice period, the CardMember must discontinue using the Card as from the date on which such changes come into effect and shall notify the Line of Credit Provider thereof promptly by written notice and return the Card cut in half and punch a hole on the chip.
       
    c) If the CardMember uses the Card after the date on which the notice of any change in these Terms and Conditions is to take effect, the CardMember shall be deemed to have accepted and agreed to such changes without reservations.
       
    d) Any statements or notice referred to in these conditions shall be deemed to have been received by the CardMember after postage to the CardMember’s last known address.

    Collection Agents
    The CardMember hereby expressly agrees that the Line of Credit Provider shall be entitled to appoint an agent(s) in its absolute discretion to collect all sums due and owing to the Line of Credit Provider from the CardMember under the Line of Credit.

    31.
    Line of Credit Provider’s Discretion
    The Line of Credit Provider shall be entitled at its absolute discretion and at any time to disburse or withhold disbursement or to allow partial disbursement of any drawdown of the Line of Credit or to refuse to allow any disbursement at all or to suspend or terminate the Line of Credit. Notwithstanding the above, after termination of CardMember’s Line of Credit, any credit balance below RM5.00 shall be absorbed by the Line of Credit Provider as petty balance adjustment.

    CardMember’s Liability

     
    a) The Principal CardMember is liable not only for all charges, fees, interest, late payment charges and other costs and incidental expenses incurred by him and debited to the Line of Credit Account but also agrees to be jointly and severally liable with his Supplementary CardMember(s) for all charges, fees, interest, late payment charges and other costs and incidental expenses incurred by his Supplementary CardMember(s) and debited to the Line of Credit Account.
       
    b) In consideration of the Line of Credit Provider making or continuing to make advances or otherwise giving credit or affording the Line of Credit for as long as the Line of Credit Provider may think fit to the CardMember and in further consideration of the Line of Credit Provider agreeing to disburse (subject to the Terms and Conditions of the Line of Credit in force from time to time) advances to settle charges, fees, late payment charges or other costs and incidental expenses and, where applicable, cash advances incurred by the Supplementary CardMember(s) in the use of his Supplementary Card(s), the Supplementary CardMember(s) agrees to be jointly and severally liable with the Principal CardMember for all said charges, fees, interest, late payment charges, legal and other costs and incidental expenses incurred by the Supplementary CardMember(s) and debited to the Line of Credit Account.
       
    c) The Supplementary CardMember hereby agrees and consents that the Line of Credit Provider may at all times without prejudice to and without discharging or in any way affecting the liability of the Supplementary CardMember hereunder:
       
     
    i) determine, vary, decrease or increase the Line of Credit Limit to the Principal CardMember and/or Supplementary CardMember(s);
       
    ii) vary or modify the Terms and Conditions of the use of the Line of Credit within the notice period to the Supplementary CardMember(s);
       
    iii) grant to the Principal CardMember or any other Supplementary CardMember(s) or any other person(s) any time or indulgence;
       
    iv) deal with, exchange, release, modify or abstain from perfecting or enforcing any security or other guarantee or rights which the Line of Credit Provider may now or hereafter have from or against the CardMember or any other person;
       
    v) compound or compromise with the CardMember or guarantor or any other person.
       
    d) The Statement of Line of Credit Account of the Line of Credit Provider as to the monies and liability for the time being due or incurred by the Supplementary CardMember(s) to the Line of Credit Provider shall be conclusive evidence in any legal proceedings against the Supplementary CardMember(s).
       
    e) In the event of loss or theft of the CardMember’s Card, the Line of Credit Provider may resolve that the CardMember’s liabilities shall be limited to RM 250.00 for any debits to the Line of Credit Account arising from all transactions effected before receipt of notification to MBFC of such loss or theft, PROVIDED ALWAYS that the CardMember has not acted fraudulently or negligently and has informed MBFC or its agent promptly upon discovering that his Card is lost or stolen.
       
    In this section unless the context otherwise requires and save as specifically defined under this section, words and expressions defined under the section “Definitions” shall have the same meaning when used in this Section.

  22. Changes on the CardMember’s Terms and Conditions 18th April 2011

    With Reference to the Bank Negara Malaysia (BNM) new guidelines, kindly be informed that MBF Cards has made changes to the CardMember’s Terms and Conditions for below mentioned clauses.

    Please note that these changes will take effect twenty one (21) days from the above notice date.

    Below are the revised clauses on the CardMember’s Terms and Conditions:

    Page 2 to 3, Clause 2.13 and 2.14

    2. Card

    2.1 The Card is and shall at all times remain our property and shall be surrendered to us immediately upon our request.
       
    2.2 We shall be entitled to at our absolute discretion to withhold or renew any Card.
       
    2.3 All charges, interest and debits set forth in the Statement of Account incurred by and/or in connection with the use of the Card must be paid to us.
       
    2.4 The CardMember shall not use the Card for any unlawful activities, including but not limited to illegal online betting and online gambling.
       
    2.5 If we do find that your Card number has been used for unlawful activity, we shall be entitled to terminate the use of your Card without prior notice.
       
    2.6 For the purpose of effecting any cash advances via the Automated Teller Machines (ATM), we will provide a PIN to you. We will issue and deliver the PIN to you at your own risk. We may, without in any way being obligated to do so, request you to collect the PIN personally.
       
    2.7 The PIN is strictly confidential and you shall not disclose the PIN to any person under any circumstances or by any means whatsoever. You are to be fully responsible and liable for all transactions effected by the use of the PIN whether with or without your knowledge.
       
    2.8 You shall forthwith notify us in writing of any changes in your or your Supplementary CardMember(s) residential address, telephone number or change of employment or business.
       
    2.9 You are to update your particulars at our request from time to time.
       
    2.10 You must undertake all reasonable care and precaution to prevent loss or theft of the Card.
       
    2.11 You are obligated to inform us, or if outside Malaysia, to inform any member institution, Visa International and/or MasterCard International (whichever is applicable) immediately to confirm in writing if the Card is lost or stolen. You must immediately lodge a police report and forward a copy of the report to us.
       
    2.12 If the Card reported lost/stolen is subsequently recovered, you shall return the Card cut in half and punch a hole on the chip to us immediately upon recovery.
       
    2.13 Your maximum liability for unauthorised transactions as a consequence for lost or stolen Cards shall be confined to a limit specified by us, which shall not exceed RM250, provided that you have not acted fraudulently or negligently or have informed us as soon as reasonably practicable after having found that your Card is lost or stolen.
       
    2.14 CardMember is liable for any unauthorised transaction if he has acted fraudulently or negligently or has failed to inform the issuer as soon as reasonably practicable upon discovery of the loss or theft of his credit card.
       
    2.15 All Cards are our property and may be withdrawn at any time at our discretion without notice and without assigning any reason thereof. You hereby expressly consent to us withdrawing the Card at such places and at such times as we deem fit, including being in the presence of or to the knowledge of other persons whether or not the Statement of Account is in credit or otherwise. Subsequently, you shall return to us all Cards cut in half and punch a hole on the chip issued to you, when asked to do so, even if the use of the Card was suspended or cancelled by you.
       
    2.16 Upon cancellation or withdrawal of the Card, the entire unpaid balance under the Statement of Account shall be immediately due and payable to us.
       
    2.17 You may terminate this agreement by returning the Card cut in half and punch a hole on the chip to MBFC. Until the Card is cut in half and punch a hole on the chip is received by us, your liabilities shall continue. Such termination shall be without prejudice to your obligation to pay to us all monies owing to us prior to the date of termination of this agreement.
       
    2.18 We may without notice at our sole discretion without any liability whatsoever deny any transaction charge using the Card(s) at any time and we are under no obligation to offer any explanation whatsoever for such denial.
       
    2.19 We may, at your request, but without being obligated to do so, reinstate the Card cancelled by us due to credit reason(s) and charge an administrative fee for each Card reinstated. We reserve rights to vary the administrative fee of RM50 from time to time.

    5. Cash Advance

    5.1 Where applicable cash advances may be given at designated Automated Teller Machines (ATM) in Malaysia or such other countries as shall be approved from time to time or at designated offices or locations pursuant to Terms and Conditions for cash advance made between you and us. You shall pay us a cash advance fee of 5% of the amount advanced or RM15.00 (whichever is higher). The cash advance fee may be varied from time to time without prior notice to the CardMember. All quasi-cash transactions which include but not limited to purchase of lottery tickets and chips at gaming casinos, off-track betting and wagers at race tracks will be treated as Cash Advance transactions and the relevant Cash Advance fees and finance charges will apply.
       
    5.2 We reserve the right to determine the total amount of cash advances withdrawn by you, the amount of which may be lower than the limit assigned to you at anytime.
       
    5.3 Principal CardMembers are allowed to withdraw cash advance up to 70% of the available credit limit.

    10. Overseas Retail Transactions and/or Cash Advance Withdrawals

    10.1 All foreign currency retail transactions and/or cash advance withdrawals shall be converted into United States Dollars and then converted into Malaysian Ringgit at prevailing exchange rate on the Posting Date at the respective processing centre and 1.5% of the converted amount shall be payable as service charges.

    16. Termination

    16.1 All monies due and owing by you hereunder shall at our demand become immediately due and payable without prior notice upon any of the following occurrences:
       
     
    a)you failing to perform and/or to observe any of the Terms and Conditions herein.
       
    b)us suspending, terminating, or withdrawing your rights to use the Card.
       
    c)in the event of your death or you become insolvent, committing an act of bankruptcy or in the case of you being a company, a petition is presented for your winding up or a resolution is passed for your voluntary winding up.
       
    d)you failing to pay any other indebtedness owed to us when due.
       
    e)if in our opinion, your account (including any other account you may have with any other institution) is or has not been operated satisfactorily and/or if you commit of threaten to commit a default of any provision of any agreement, or security documents, or both (as the case may be), relating to other accounts or loan facilities granted by us or any other institutions to you or other party in which you are a guarantor, or chargor or assignor.
       
    f)any order for execution, writ of attachment, garnishment, or any other legal proceeding is issued against you.
       
    g)an event has occurred or a situation exists which could or might in our sole and absolute opinion:
         
      i) prejudice your ability to perform your obligation herein or
         
      ii) prejudice the repayment of the amount due and payable to us or the Minimum Repayment under the Statement of Account.
       
    16.2 Notwithstanding the above, upon termination of the Card(s) any credit balance below RM10.00 shall be absorbed by us as petty balance adjustment.

    2. Lost and/or Stolen Card

    c) MBFC may resolve that the CardMember’s liabilities shall be limited to RM250.00 for any debits to the CardMember’s Account arising from all transactions effected before receipt of such notification to MBFC, PROVIDED ALWAYS that the CardMember has not acted fraudulently or negligently and has informed MBFC or its agent promptly upon discovering that the Card is lost or stolen.

    d) CardMember is liable for any unauthorised transactions if he has acted fraudulently or negligently or has failed to inform the issuer as soon as reasonably practicable upon discovery of the loss or theft of his credit card.

    e) If the Card reported lost/stolen is subsequently recovered, the CardMember shall return the Card cut in half and punch a hole on the chip to MBFC immediately upon recovery.

    17. Cash Advance

      i)

    determine, vary, decrease or increase the Line of Credit Limit to the Principal CardMember and/or Supplementary CardMember(s);

      ii) vary or modify the Terms and Conditions of the use of the Line of Credit without notice to the Supplementary CardMember(s);
      iii) grant to the Principal CardMember or any other Supplementary CardMember(s) or any other person(s) any time or indulgence;
      iv) deal with, exchange, release, modify or abstain from perfecting or enforcing any security or other guarantee or rights which the Line of Credit Provider may now or hereafter have from or against the CardMember or any other person;

  23. Changes on the CardMember’s Terms and Conditions 1st March 2011

    Kindly be informed that MBF Cards has made the changes on the CardMember’s Terms and Conditions for the credit balance amount that will be absorbed as administrative fees by MBF Cards or Line of Credit Provider, in the event that CardMember(s) terminate their MBF card.

    Please note that these changes will take effect twenty one (21) days from the above notice date.

Based on recent complaints received by Bank Negara Malaysia, there has been an increase in incidents of fraudsters sending SMS and making telephone calls to unknowing members of the public in order to deceivingly obtain their personal banking and credit card information, with the aim of siphoning monies from one's account.

    It is important to note the following details:

    There is no department called “Unit Kad Kredit Palsu” in Bank Negara Malaysia.
    8659-xxxx is not a Bank Negara Malaysia telephone line.
    Bank Negara Malaysia will NEVER request for personal banking and credit card information via SMS or telephone calls.

    In general, we wish to advise all CardMembers to be cautious of these fraudulent SMS and telephone calls and to be reminded not to disclose your personal banking and credit card information to any unknown party without verification.
